Can I claim points for Sibling who is PR holder but who never stayed in Canada?? My sibling got PR one year back, he did the landing and have PR card also. He actually never lived in Canada but have plan to shift to Canada next year.

Not true. Your PR status is valid as long as you spend 2 in every 5 years.

@binga777, you can't claim points because you need to prove that your sibling resides in Canada. Check here:

Under Proof of relationship to a relative in Canada, status of a relative in Canada and residence status of a relative in Canada (including a brother or sister for the purpose of obtaining additional CRS points):

"Evidence that the family member currently resides in Canada must be provided (a residential lease, mortgage documents, utility bills, etc.).
The documents must show their address in Canada and should be recent (dated within six months prior to submission)."

I agree with upperkut's assessment that you cannot claim the points.

My understanding of the reason you are able to claim points for a sibling with PR or Citizenship, is because research has shown that persons who have siblings already living in Canada settle more readily and more successfully than those who don't. If your sibling has PR, but doesn't actually reside in Canada, it means he wouldn't really be able to contribute to your ability to settle, which would imply that his having PR alone isn't adequate - his actual physical residency in Canada must also be a part of the requirement. There is a specific field in the online PR application (once you receive an ITA) to upload proof that your sibling is resident in Canada (utility bills showing his address, rental lease, etc.) so I am pretty sure this is definitely a requirement.

Following up on what OdinNguyen and upperkut said though: my understanding is that one only needs to spend 730 days in the 5 years physically present in Canada in order to maintain permanent residency; so, although your brother isn't actually living there, he should still have his permanent residency (for now).
