I would like your advise on my case;
My wife is a qualified Interior Designer from India & has been living in UAE on Husbands visa. She has been working for a Dubai based LLC co. for some years now operating from home & travels occasionally for client meetings & site visits. The Co. has been paying her monthly salary in Cash since its a small business (under 10 workers) & the amount paid is very small.
Recently, I applied for EE with her as the PA & received an ITA, however, the problem now is, she has never been issued a UAE Labour Card by her employer! In past we never bothered about checking the legalities of her working in UAE as she usually worked from home, her employer is very flexible with her working hours & has remained punctual with payments.
Her employer, on our request, has issued us an Employment Letter which clearly says she works for them along with other details usually required by IRCC, like Position, Responsibilities, Salary, Dates From - To, Working Hours, Contact info., copy of Co. Trade License. Co. Stamp, on Co. Letter Head. etc.
However, now I am worried, will her work experience be considered genuine by CIC since it is not acquired working legally in country of residence? which I have to admit was not done deliberate & we were just not aware of the UAE Labour law. Moreover, we don't want any trouble or fines for her employer as he just manages to meet ends in his business.
Now that we know, we will be taking needed steps to make her employment legal by applying for her Labour Card discussing it with her employer & shouldering some of the charges ourselves.
Question is, if this is done, will CIC consider her experience gained in past i.e. before the issue of Labour Card in points calculation? Its important for us to make her past work experience count, for at least 6mnths else we will not meet the minimum FSW criteria (1year, 1560 hours, Continuous, in same NOC)
