Can I stay in Canada while application is processing?

I could really use some help!

I am applying within Canada through common for residency. My partner is sponsoring me to be able to do so. I was told by many people that although my visitor visa expires on September 9th of this year that once the application in received I could stay here while it is being processed. But I saw on another thread that this might have changed in 2014 and that I might need to apply for an extended stay? Please help any information would be really helpful.

Applying for PR does not grant you status in Canada. If you are applying inland, including an OWP app will maintain your status. If you want to be extra cautious, you could also apply to extend your visitor status; if for any reason the PR/OWP app is returned (missing signature, wrong form, missing info etc.), your status would still be maintained.

So as long as I apply for the open work permit I am able to stay in Canada? I heard this takes about 4 months to be received, so even while the OWP is being processed I have legal status?

you can stay as long as your tourist visa is valid irrespective of your current PR processing status. You may request for your stay extension for another 6 months. but in case your request is denied, you must leave canada else your stay will be violation of the rules.

You can extend your stay as visitor or open work permit .You been told repeatedly

It is not required but as I said, it is a good idea just in case your PR/OWP app is returned after your current status expires. That would leave you out of status.

Yes you can. However you would also have to apply for a "restoration of status" if your application is returned after your visa status expired. You must do this within 90 days since the day your status expired and went into "implied status" (not within 90 days after receiving the returned application). You would not be able to qualify for OWP then since OWP are for those who have valid status in Canada. Those who are "out of status" do not qualify for OWP until their status is restored.

You also have to keep in mind when resubmitting the application, make sure the forms are up-to-date as well. If the application forms have since been updated since you submitted the application, you will need to redo the new application forms. Not all the forms, just the ones that are updated.
