Hey All,
Can someone plz give me some info on applying for asylum through Viva La Casa in Buffalo? I am in the USA but in Florida. My sister in law is a Canadian citizen and she is willing to come to the border. Don't want to take the journey unplanned as I have three kids with me.What papers do I need and what will happen there? Anybody experienced it recently?
How many days do I have to stay there?
Any help will be appreciated.

Where will your spouse be? Sister-in-law is your spouse's family, not yours. So spouse would need to be there so satisfy family exemption to safe 3rd country agreement.

Think you should contact the organization directly. They should be able to give you more information about their services and what sort of timeline you should expect. I would hope they will also screen applicants to make sure thy feel that you have a chance at asylum.

It seems like you are somewhat settled in the US. I am not sure what your status is currently in the US.

No my dear the older posts that you read are from last year and I couldn't file for asylum as my father in law passed away and we had to go back. I just arrived back yesterday.

No my dear the older posts that you read are from last year and I couldn't file for asylum as my father in law passed away and we had to go back. I just arrived back yesterday.
You had to go back where, to your home country you are trying to claim asylum from?

Since your wife has a family member in Canada, she would be able to come to Canada and claim asylum at the border. She will need her sister's info on hand and CBSA will need to contact her to verify.

However if you all recently returned voluntarily back to your home country, or have a history of coming and going to home country from USA, then you should realize your refugee claim will probably have very little chance of succeeding in the end.

Perhaps you could go into the whole story. I was just commenting on today's discussion. Seems like the story is much more complicated.

So, you have relatively easy access to the US, and you have no fear of travelling back to your home country, probably on your home country passport! So what makes you think you are eligible for asylum? If you don't have an issue going back home (for any reason) you won't qualify. Pretty sure when IRCC gets your travel history and entry dates into the US you'll find your refugee claim declined and you'll be sent home (and not the US).

Dear all,
Plz don't be sarcastic and come to conclusions without knowing the whole story. I'm not only talking about myself but also about other people who come to this group looking for advice. I have read topics where the members are quick to judge people about their stories and reasons. I would also like to thank the members on this forum who are very kind and helpful to the people seeking advice.
Many people coming here for advice are desperate and at a point in their lives where going back to their normal lives is just not an option. Please be kind to them as you never know a harsh word or a sarcastic thing said by you could really hurt and break them, probably even depressing them more. I'm really sorry for this long post and forgive me if I hurt any members. My apologies

That said, there is nothing sarcastic in my post and I've drawn no conclusions. I've simply stated what you will likely face given your recent travels back to a country that you are seeking protection from and inquired what makes you think you are eligible. The things that can and will seriously affect your claim. There's no point asking opinions on an open forum if you aren't prepared for both good and bad perspectives. It's all there for you to assess and make your own preparation and decisions.

Not everyone is going to sugar coat their opinion (nor should they) and as long as it promotes health respectful conversation, there's no offence to be taken.

Sir I did not ask for an opinion and certainly not a sugar coated one, neither did I ask you or anybody else to assess my eligibility . I asked about the process and if anyone who had experienced it to share their experiences.

I did listen to people's opinions but is it ok to come to conclusions or access my eligibility with knowing my story?

People will come to conclusions based on the information you have provided. Regardless of your story, the fact that you returned to your home country is a huge indicator of a non-genuine asylum case.
