Immigrant Visa Denied - Is there Still Hope?

The Canadian government recently denied our application for permanent resident visas. We received our ITA on April 13, 2017. My total number of points back then was 423. I am a married Filipino national with a son.

I am turning 40 years old in a few days. That means I will lose five points based on the age factor. We plan to re-apply for Express Entry. My total number of points will be 418 when we re-apply. What are the chances the Canadian government sends us a new ITA?

On a side note, the Canadian government denied us mainly because of an outdated FBI police certificate we submitted (dated August 2010). They were concerned about our five-week stay as visitors in the USA from November 2011-January 2012.

The truth is, I filed for a new FBI police certificate on April 26 (way before our July 12 ITA deadline). This document is still in process until now. There was no way we would have met the July 12 ITA deadline even if I sent the application for the new FBI police certificate a week or two earlier.

We plan to appeal the denial and re-submit a new Express Entry Application. Is there any hope for us?

No need to go back to EE pool again. If you can provide new police clearance certificate ASAP, just email or fax it to CIC with Letter of explanation. They will reopen your case. Happen with me as well. PCC was rejected and we got fresh PCC within 3 weeks and sent new PCC and LOE to CIC. Our case was reopened in 1 month time. Whats your exact timeline? When you received rejection?

My PR process is still ongoing .. into 8th month now. My AOR is Dec, 2017. Since you got rejection recently, try to get new PCC ASAP and send to CIC. All the best!

You probably have better chances appealing the rejection and sending the new PCC with LOE. If an ITA comes along at or below 418, then you can open a new application at that time. For future reference, you can always submit an application while PCC is pending. Just include the receipt and a description in LOE.
