Following is a requirement for spousal immigration:

Divorce certificates issued in Pakistan must be issued by the relevant union council or government authority. The NADRA (National Database and Registration Authority) issued divorce certificate should be included but is not sufficient evidence on its own. You must include the Certificate of Talaq issued by the relevant Union council. In the case of Khula, you should also include the decree of Khula issued by the Family Court.

Now normally one gets a Khula certificate from court which is submitted to NADRA after which nadra will provide the divorce certificate, this way we only have divorce/khula certificate from NADRA and not from family court as that was already submitted to them.

How do I provide decree of khula issued by family court then in this case?
 
U have to submit all correspondance done prior to divorce between u n ur ex through court. I mean aĺl court papers and summons translated n attested by notary public

I have not applied yet, I will apply in few days from now.

I understand that you have to submit everything but how to submit these things when Pakistani govt has a process and as per that process they will grant khula through family court (this was done long time back) and that original khula paper has to be submitted to NADRA after which they will give you a NADRA divorce certificate. I dont have any photocopy of that document

I am in a similar situation. About to send my application. Any luck with the answer? I don't understand why NADRA certificate is not enough. I dont have any other document. Can you please tell me what exactly you submitted? Or did it cause any issues/problems?

Did you have to go thru the union council to get that document before divorce? And did you submit it with the application or was it something they asked you about later? Is it a must?

I am in the same situation.
1-My wife filed for KHULA in family court
2-Family Court Sent notice to the X-Husband to show to court or Give Divorce (Note: this notice is sent 3 time before the Justice of Peace Grants the divorce)
3-He chose to give divorce (Divorce Deed the 40 Rupees Stamp paper)
4-The Union Council made the Divorce Certificate as KHULA and Authority Granting Divorce as JUSTICE OF PEACE

NOW: She does not have any documents that prove that JUSTICE OF PEACE granted her the divorce, she only has case filed in the court.
This happened in Jan 2004.

Could this be a problem. I am planning to apply a common-law since we got married in 2009 and MY divorce was not finalized in Canada till 2010 we have 4 kids from current marriage.
Any advice if Nadra Divorce Certificate could raise and objection.

NADRA is only database holder who kept record of birth, marriage, death, and divorce. It has nothing to do with divorce process. Only Union council execute all process of divorce. ALLAH karay goroan ko is bat ki samjh a jaye (ameen suma ameen)

Yes I agree, but in the country specific requirement for PAKISTAN it is stated that

      • But in my case there was no decree of Khula issued by the Family Court, on the first notice the x-Husband sent her the divorce deed (talaq namah).
      • Need advice senior member or applicants who had similar issues, it will really be grateful.
 
Advice from People who have gone through KHULA process or are currently have an application in process.

The question I have is
If I give the Nadra Divorce Certificate issued by the Union Council that say,
  1. Divorce Certificate as KHULA
  2. Authority Granting Divorce as JUSTICE OF PEACE
  3. Date of Notice of Divorce: 22 Jan 2004
  4. Date of Failure of Consolation: 22 Jan 2004
  5. Date of Effectiveness of Divorce: 22 Jan 2004
  6. Date of Entry: 14 October 2017
  7. Date of Issue: 14 October 2017
Will there be an objection a BIG RED FLAG of what is going on by the Visa Officer over this KHULA issue, and the application gets rejected?

My wife does not have any document from the court that say decree of Khula issued by the Family Court. Just the Divorce sent by the X-husband.

FYI Note:
I am applying as Common-Law partner and not as Married Couple. we were married in Karachi in 2008 and my final divorce from my Canadian Wife was not completed till 2010. So we are not considered as married couple as per Canadian LAW.
 
Hello guys I don’t understand what does Nadra issued divorce certificate vs certificate of talaq by union council means?? Isn’t certificate of talaq issued by union council same as nadra issued divorce certificate??
