Helllo all ,
I was refugee and it was refused in 2011 . I am under deportation order since than but I do not have valid travel document or passport to go back . I never had passport . Indian GOV isn't making me passport as I did refugee claim and they didn't I've it to CBSA as well .
Now I am married to PR guy . I am currently 19 week pregnant . I want to do inland spousal application but I don't have passport to stamp if they give me PR . No lawyer have answer or CIC . I called CIC and agent has no idea . They just told me to try . Please help .. if anyone knows anything how they process application for refugee without passport .i haven't seen my family since 2007 . They are not giving visitor visa to my mom even . So stressed.
Please help.. thank you

I don't believe it's possible to apply for PR without a valid passport or travel document. This might be a good time to consult with a very good immigration lawyer.

India consulate/embassy in Canada will not renew your passport since you've tried to claim asylum here. You must physically return to India first to explain your situation and attempt to renew your passport. If you can get a new passport (which from what I gather is not even guaranteed), only then can you apply for PR status. Of course once you return to India, you will most likely not be allowed to return to Canada until your PR is approved.

I've never heard of a family sponsorship case of someone getting PR status without a valid passport. There may be ways, but if so I have no idea.

Passport Service to Refugees
No Passport Services (and many other services such as OCI card or PIO card) are rendered to refugees or asylum seekers. Any Indian citizen who has sought refugein any country on political or any other considerations (such as humanitarian or compassionate grounds) is not entitled to have his Indian Passport re-issued. This is so as there is no reason for citizens of India to take "refuge" in a foreign country in view of excellent political, economic, social and financial opportunities available to citizens in India. Therefore, cases which have been or are being considered for Permanent Residency in Canada on political asylum or humanitarian/compassionate considerations (known as CR and HC class of cases) will not be given Indian Passport. However, such persons, for the purposes of returning to India, may apply for Travel Document through Canada Border Services Agency (CBSA). They will be issued an Emergency Certificate (EC) which will be handed over to them at the time of departure from Canada at the airport by an officer of the CBSA. The EC is good for one-way travel from Canada to India. Please note that EC is not a Passport and is not valid for normal international travel. Also please note that an EC will have a note written thereon that it is being given due to the fact that holder had taken refuge in Canada. In India also, Passport facility may be denied to such a person, depending on the circumstances in which he was given the EC.

I spoke to 10 different lawyer and they don't know what to do . I paid 300 consulatation fee to all of them as well .
