Hi guys,
Ive been divorced from my former spouse for 3 years now..we separated in the 2 months of me arriving in canada..theres no condition on my pr..we both have a kid..and cic sent me an email reviewing my pr? Ive been paying child support but have no criminal record what so ever
.i.mean am i getting deported guys? Whats the likelihood of that?

A report under section 44(1) of the Immigration and Refugee Protection Act may be prepared alleging that you may be inadmissible to Canada under paragraph 40(1)(a) of the Immigration and Refugee Protection Act, which states:


40. (1) A permanent resident or a foreign national is inadmissible for misrepresentation


(a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;


Regulation 4 of the Act states:

4. (1) For the purposes of these Regulations, a foreign national shall not be considered a spouse, a common-law partner or a conjugal partner of a person if the marriage, common-law partnership or conjugal partnership

(a) was entered into primarily for the purpose of acquiring any status or privilege under the Act; or

(b) is not genuine.

Yes - it looks like CIC is investigating you for marriage fraud. If they find against you, your PR status will be revoked and you will be ordered to leave Canada. I would start working with a very good immigration lawyer immediately.

At the specific time you landed as a PR, were you already going through separation or at that time were you still happily together?

They separated two months after landing. That's extremely fast - so not all that surprising CIC is willing to investigate. Even without conditional PR, it's still possible for PR status to be revoked if CIC determines it was a marriage of convenience / marriage fraud.

Divorcing after two months of arriving in Canada is a red flag to immigration auhtorities. They deal with many cases of immigration fraud through marriage of convenience,where one party pays the other to get married, so they can claim their permant residence status in the country and divorce shortly after..

We had a big fight resulting in our divorce.. Cic emailed me to resubmitt everything how genuine our relationship was. Pretty sure they just wanted to know it was serious... Just have to prove it?

Yes - CIC is looking to validate your relationship is genuine. The fact they are investigating you is a serious matter. It might be wise to have an immigration lawyer ready on the side in case CIC comes back with any concerns about your relationship and indicates your PR status may be in jeopardy.

Again would ask, what was the relationship like as of the specific day you landed as a PR? Had you already initiated separation at this point??
