Citizenship by descent

Hi folks! While I was visiting my relatives in Nova Scotia for Canada Day, I learned that I may be a Canadian citizen based on the rules changed in 2009. I've taken the 'quiz' that others have mentioned and it says I'm likely a citizen. Yeah!

I do have a question, but first here is my situation. My mother was born in Canada in 1942, to Canadian parents. She moved to the US in 1967 when she married my US father, but she did not renounce her Canadian citizenship. She obtained her US Citizenship in 2002, but again, did not renounce. I was born in the US in 1968, but she never pursued any citizenship for me (and based on the law at that time it looks like I would not qualify since the Canadian parent was not my father...if I'm interpreting that correctly).

I believe that I qualify based on the 2009 law, but my question is this: what would the effective date of the citizenship be? Is it 2009 when law went into effect? Or would it be when they issue the certificate? Or, is it possible that it would be retroactive to my 1968 birthdate?

I appreciate any info from your experiences or knowledge. Thanks!

You are a citizen as a result of the 2009 changes, but your effective date of citizenship is your date of birth. If you have any children, they would not have inherited Canadian citizenship from you, because citizenship by descent has been limited to the first generation born abroad.

Wow, thanks for the quick reply alphazip. I have no children, but will pass this along to my siblings who do. Amazed that the effective date is my birthdate but very pleased. Time to send in my documentation for a certificate!

Welcome to the Canadian family! Now, you might want to consider contributing something to the folks fighting the government in the Supreme Court to get expat voting rights back, so you can vote here too.

Though my son was only two ( he was born in the US in 2014, I became a PR in Canada in 2015) I was surprised his birth was the effective date. ;) His dad is Canadian.
