If an person is currently an illegal immigrant in US. (Entering with visitor visa) could that person apply to express entry even with other documentations in rule? Thank you.

If you have lived for more than six months in the US, you'll need to provide an FBI clearance certificate. I don't think you can get that as an illegal immigrant, thought I'm not absolutely sure about that.

Sorry, I really don't know how overstaying a visa is looked at by CIC. I'm pretty sure you need to be in legal status in the country where you're applying from, but this isn't an area of expertise for me. Perhaps other people can help out.

If you have work experience that qualifies for express entry in your home country, you can apply. However, you will have to apply for FBI clearance which is possible even as an undocumented.

I would Highly recommend to get a lawyer. He will be the only person who can guide you with your situation.

In my head best thing would be to go back to your home country. Because your stay is going to raise many questions. If you have been in the U.S. for more than 6 months you need to have FBI clearance and to get that you need to provide all your details and once you send it to them they will get to know everything and it can be a trouble.

If you have a social security number, a clean record and can prove it (get fbi clearance), have valid work experience and documentation to prove that, education credentials assessment, sufficient ielts score and meet other requirements, as far as i know, you can apply.

Am I the only one who wish you don't get the chance to enter Canada? You are a potential threat for Canada!! Illegal is illegal and I hope, no matter how hard you try, you won't get here.

Are you serious??? No human is illegal, some people happen to have been born in countries where opportunities are scarce and try for a better life. What if you were from a country that couldn't offer a good life? Do you realize that borders are social constructs? Honestly shame on you for that horrible comment. I would rather have OP living as my neighbour than someone like you.

Are you serious?? There is this thing called "law" and nobody should break it! If life in your country sucks (as in mine), find a legal way how to stay in another country but don't choose the one you want the most and stay there illegaly! That's not a good way! I also wish I could live in the US but I can't so instead of that I've found Canada where I can legally stay.

Your country of origin does not allow you to choose any country in the world to stay there illegaly, there must be another country which allows you to stay legally!

Well, the OP overstay in the US. He could have extended his visa or applied for a working visa thru all legal means. It doesn't have anything to do with where he was born and opportunities are scarce or not. Canada would likely deport people like OP unless he has a legitimate reason for being unsafe to go back to his country(such as there is a civil war going on or he is seeking asylum).
Instead, OP is asking about EE, which means he should possess a certain level of education and working experience. I could be wrong but his overstay seems more like one was trying to take a short cut for a better life but failed.

Anyway, he needs a lawyer.

I cannot see any issue for a person described on #1 applying the FBI Clearance certificate.

The US does not track ppl leaving the country by land at least. They never know whether you left or not.

Just apply for it and ask it to mail the certificate to your friend's place..I think that is something worth to try.

Though I assume the Canadian immigration officer will question the person's stay in the US anyway, he/she always has a chance to explain.

The better way to get these things sort out is to hire a licensed canadian immigration lawyer.
