In Canada, there is a provision that divorce can be applied for without consent. This is used when you cannot locate the estranged partner to work out divorce paperwork. It's equivalent to an uncontested divorce.

In Hong Kong, they do have a similar provision (apparently -- not at all a law geek from HK, so you might have to do some research here):

Separation Without Consent- Parties have been separated for two years and now of one of the concerned parties wants a divorce. The spouse's consent is not required in this case.

With respect to the notice CIC sent you -- you did know they were going to ask for divorce certificates (or paperwork to prove it was granted), right? That said, you can write them a letter explaining that you have applied for "Divorce in Hong Kong on the grounds of Separation Without Consent. You will send them the paperwork once it becomes available." Provide proof of filing (a clerk will give you paperwork to state the court has received the paperwork).

CIC will suspend processing until they receive that proof.

My mom is a licensed nurse. She has been volunteering her time at a community centre run by the city we live in... My dad, volunteers his time to the TV. True story.

I just call her Carol. But for a time, she was pretty down about the process. Hard to keep people upbeat :)

When you dont know what is really happening, its like the world on your shoulder. I am not generaloy a calm person, but i see that the process is an everyone process so i dont make it an issue. Am i anxious? Absolutely!!!!:rolleyes:

My in laws are looking forward to going to jamaica, they nkt leaving without me:mad:
There are little things that could cost concerns, but like i said earlier, God said He got this
And if he says no, , , there must be a real dood reason why.
Each man's burden is always the heaviesy:cool: always, and each deals with the situation, but from what i have seen, there are some person, here in canada, citizens, they wish they had health, wish they did not have to depend on another person, wish they were still able bodied, wish they could trade their citizenship status for my ability to move about freely:( lol lol

When did you apply again? Refresh my old remembery...

Keep in mind this: In as little as 2 years from the time they grant your PR (and they will), you can apply for citizenship. That process (from what I hear) is pretty quick. Benefits? You can vote; you can apply for a blue passport that may give you freer movement, etc.

You can leave if there is an emergency. Generally it's only a problem at the border. As long as you can cross, you're ok. Don't stay out for more than 30 days.

On the brighter side: on father's day, my son, my dad and I worked my car's electrical. What's a father-son-grandson event like that, without the obligatory electrical fire? Yup, smoke curling over the engine within 5 minutes. Good times :)

EDIT: It wasn't a terrible burn -- it was contained to the starter motor. The brushes fused to the armature. Makes for an easy diagnosis and has long since been fixed :).

You must file where the marriage happened. Canada cannot grant a divorce for HK. Canada has no jurisdiction in HK. Like asking if Canada can sentence HK residents to jail just because...

Once you file, you will have proof from the clerk that it was filed. You can give that to CIC.

Well, with respect to CIC, they need to see that you are even trying to resolve it (technically, he is married still. And until that is resolved, they don't recognize him as a member of the family class. They did you a favour by asking for proof that he divorced). If they see the proof, they will wait. If you ignore the letter from them, or do not send them proof that it's in process, you will lose your $475 and the $75 for the sponsorship approval. And they will likely refuse on the grounds of bigamy.

You can try to see if the courts in HK will permit filing remotely. If so, perhaps they can respond in kind? That's the best I have got for you, unfortunately. I'm not a divorce lawyer...

Do I have to bring employment letter for the landing interview? The landing interview letter states "Proof of income for yourself and your sponsor/spouse. Proof includes recent paystubs, employment letter."
Are paystubs enough for proof of income? :/ my husband is too shy to ask his boss give him a employment letter but we have a lot of paystubs.
When my husband did his landing in cic Etobicoke they did not ask for paystubs just passport and etc

at this moment, citizenship is processed in 12 months (according to cic processing time).
