Clearance from FBI and State police USA

Hello

I am on immigrant visa in USA from last 5 years and will be moving back to the country (INDIA). I would like to apply for Express Entry/ Provincial PR with my spouse by this year end or early next year. As I am into IT and my spouse is in health Care (back in home country) I have few questions as I am exploring lot of things

1. Which PR entry would be beneficial and quicker Provincial/Express entry . If we consider regarding the jobs and career growth.

2. AS I lived in states for last 5 years I would be needing a PCC from FBI. Should I do it now or when I start application process. Because I will be applying by End Of the Year or early next year.

3. In addition to the FBI clearance, individual state police clearance?
Since I lived in more than 2 states during my stay in USA. Can I request it while I am out of the country.

4. What are the approval odds or getting selected for PR invitation. How long does it take to get a call ?

5. Should I hire an attorney or I can do it myself? Any suggestions for hiring an attorney.

2. AS I lived in states for last 5 years I would be needing a PCC from FBI. Should I do it now or when I start application process. Because I will be applying by End Of the Year or early next year. Give yourself 3-4 months before your departure and then APPLY as soon as possible as the process takes a while, and it is quicker for you to receive the certificate when you're in the country.

3. In addition to the FBI clearance, individual state police clearance? You don't need individual state police certificates, only FBI Identity History Check. Also, it always better to request when you're in the country (quicker coordination, submission of missing docs, etc..)

4. What are the approval odds or getting selected for PR invitation. How long does it take to get a call ? There are no odds, it all depends on your score. Perform a CRS score assessment to see where you are and then compare it to the minimum point draws occurring to see if you cut it!

5. Should I hire an attorney or I can do it myself? Any suggestions for hiring an attorney. A lot of us are doing this by ourselves, so many people are helpful, I am currently in the process of submitting my docs with the help of the Forum and no attorney. However, it is up to you.

Since you will be applying from India which will be your country of residence at the time of application, your FBI PCC should be dated after your departure from USA - please keep that in mind. If you obtain it while living in the US and then apply from India, it will be rejected. So ideally send your application to FBI about a month or so before your known departure so its dated after exit from US.

This is the right answer - you absolutely need to make sure your FBI PCC is dated after your exit date if you're applying from India.

There's no difference, and neither will help nor hinder you in your job/career growth. Whether you become a PR via PNP or FSW, the end result is exactly the same, and employers will not care. They will ask if you're allowed to work, and once that's answered, will treat you like any other candidate.

That being said, FSW-O EE candidates usually get a PR a month or so before the PNP candidates. If your CRS score is above the cutoff, going through the PNP route is pointless.

You only need the FBI PCC.

It's very simple. If your CRS score is above the cutoff, you will be invited. That's all there is to it.

5. Should I hire an attorney or I can do it myself? Any suggestions for hiring an attorney.
That's entirely up to you. I did it myself, as have many others, and it's a pretty straightforward process. However, if your case is complicated, an attorney can help. Complicated would mean things like a non-clear PCC, a tangled family situation, etc. etc. You should know if your case is simple or not.

IELTS is mandatory for everyone - you need it before you can create an Express Entry profile - no exceptions

Accompanying spouse and any kids under 21 will also get PR - sponsoship is applicable only if you have a family and you indicate them as non accompanying

Yes - you can choose

Minimum cutoff is decided by CIC based on the number of ITAs they issue. Previous draw the score went down to 413. Any score above 430 is good in the current scenario and you can expect ITA in the next draw after you create your profile.
