Hello,

In case of being in the airport on transit visa waiting for the flight. I have a baby who have a heart disease, he is only 8 moths old. If I waited until the flight final call or whatever, and then we act like we don't know what is the problem with the baby as his breath is too fast. What will be happen ?

Will they help us in hospital ?
Will they let us enter Canada to the hospital ?

My point is, that I got different answers from people about the chance of making asylum on transit visa. Some said YES, some said NO you have to enter Canada !

So, If we couldn't made the refugee while transit, and then we acted like this situation for the baby, will we get benefit by that to enter Canada and make refugee ?

Is your child your only qualification for refugee/asylum status as it is unlikely to be approved given coming to Canada for medical treatment is not really the intention of any refugee/asylum program? If as you say in other posts you live in Saudi Arabia does Saudi not have medical facilities that can manage your child's condition ?

The child is not the reason to seek asylum, We have political problems with our country and we have evidences, please read my question well and try to understand it to answer.

My point is, that I got different answers from people about the chance of making asylum on transit visa. Some said YES, some said NO you have to enter Canada !

keep in mind airports have experienced medical staff so will assess any medical issue first in the airport so you should not assume an automatic hospital referral.

If transiting international to international then it is possible you would pass through immigration before arriving at the departure gate so maybe that would be your opportunity to claim asylum.

Have you consulted with a doctor about flying with your babies heart condition? Air travel could put it at significant risk.

Look it is not a question of legal or not it is a question of whether your plan gives you the opportunity to face an immigration officer hence you need to investigate if international transit requires you to pass through immigration when arriving in Canada, I cannot confirm that..

Your plan to use your ill child as a means to get the opportunity to ask for asylum most people might consider morally wrong especially travelling so far but thats up to you and nobody is here to judge that plan which is not guaranteed to be successful anyway..

Asylum is never guaranteed and none of us on this forum as has been said on your other post are immigration lawyers or anything official so maybe you need to consult a lawyer before you make plans else it could be a very expensive exercise if your asylum case is not foolproof . If you are not as I think I read correctly even residing in your country of citizenship have you even checked how that affects your case, not that I have any information on that.

it's seems this guy is willing to come to Canada at an cost plus the medical staff is not stupid they can tell when a person has something long term why not come here like everyone else and apply for a fsw but whole family do medical even baby and that's a refusal for the baby because of Canadian health care system be paying and they do not want that what your doing is dirty and the airport staff are not stupid

Thank you, As I said doctors have no problem for the baby to fly. So, in order to claim Asylum I have to meet an immigration officer and not enough to be in the airport!

For our case, YES we have real danger from the government of our home country and we have evidence and docs proving that and we are living outside it 2 years ago.
