Legal Separation Agreement

Hey guys! I badly need your advise. I received a document request from cic asking me to submit in 30 days a divorce certificate or legal separation agreement, and signed declaration of non-accompanying parent. If I am not able to provide the first requirement, they will require my spouse to undergo medical and background check. In my profile, I ticked legally separated as my status as it is the most appropriate status looking at the definitions. I have been separated from my spouse for more than 8 years now but did not undergo the legal route - legal separation or annulment. There is no divorce in my country. I have no idea of my spouse's whereabouts and our last communication was 8 years ago as well. I have been solely providing for our daughter who is also under my care. I have already submitted a letter of explanation, affidavit of separation and as a solo parent but it seems that these docs are not sufficient.

If I am able to find him and he refuses to be examined, what can I submit to cic? Annulment and legal separation take a very long process where I'm from, not to mention very costly. If ever I file for either annulment or legal sep, will cic wait for the resolution before I get my PR approval? Or will I be refused because I have a pending case? What else can I submit to support my claim that we are separated?

If I am UNABLE to find him, what can I do?

Anyone who knows an immigration lawyer based in the Philippines? I have tried looking but can't find one.
