Staying six month continuously or cumulatively for police document?

I was wondering should I produce a police document for my stay in the UK if I had stayed there for business for three months, gone back to my home country for two months and then returned to UK for business for four months?

Yes, you need to provide UK PCC for total stay of 6 months or more.

In general, you and all the people in your family who are 18 or older need to get a police certificate. You must get one from each country or territory where you have lived for six or more months in a row since the age of 18. (For example, if you lived in a country for six months but left on a two-week vacation, that counts as living there for six months.)

For the country you currently live in, the police certificate must be issued no more than six months before you apply.

For countries where you have lived for six months or more, the police certificate must be issued after the last time you lived in that country.

Hi good Morning i believe i am in trouble> in the website cic is written this. about the criminal record. Th point is this my common law partner which is chinese an she is under study permit in canada she went back a couple of month in china from 24 april until 25 June she got successfully but with a lot of problem (because the police station in that chinese province don t issue easily a police clearance.) her PCC was issued the 31 of MAY now she will be back to canada the 25 of June is that police clearance still valid? during the last three years she went to china for Holiday just 4 month each summer and three months. Her Hukou (certification of resident) demonstrate that she is still chinese CITIZEN and RESIDENT even if she spent during the last three years more time in Canada around 8 month per year rather than China. She is 22 years old and we are applying together under my name. PLEASE LET ME KNOW. I'm afraid to be screwed. I'm looking forward your answer. Actually the point is does CIC allow the people to go in that country get the criminal record and then go back? That's the point that ti can t understand

New rules are cumulative:

"if you visited, worked or lived in a country for two months, left for a few years, then returned for four months, that counts as spending six months there. In this case, you would need a certificate."

To simplify -

If she is a resident of Canada, the PCC is valid until she returns to reside China.
If she is a resident of China, the PCC is valid for 6 months, until 30 November 2016.

As long as you get your ITA and submit your complete application before 30 Nov 2016, the PCC is valid in either case.

Which it means that for instance: my wife go China 25 of April get her police clearance the 30 May and turn back Canada the 26 of September ( one days exceeding the six months) she should in that case get another Chinese PCC record because the previous issued the 30 May would not longer be valid because she lived the last time in that country more than six month. ? this criteria should be interpretated straightforward? but is not my case right? because my wife the LAST TIME SHE WENT TO THAT COUNTRY SHE DID NOT EXCEED THE SIX MONTH. Although in the past during the last four years she lived or used to live for some times more than six month. I see from one of your previous posts that you have an LMIA. Do you also have a written offer of permanent employment? If so, when do you plan on submitting your profile? I ask because as long as you get your ITA and apply before 30 Nov 2016, the questions you are asking are moot. The PCC is valid for a minimum of 6 months, regardless of her country of residence.

However, let's assume you won't apply until next year, and you have lived all your life in China until you came to study in Canada.

Example1: You establish residence in Canada (by Canadian rules, not Chinese). You get your PCC during a visit home, and you visit for 2-3 weeks during summer and winter breaks. You are clearly just visiting China, not returning to reside, so your PCC is still valid.

Example2. In addition to Example1, your spouse has accompanied you to Canada, but she spends more time in China when she returns - 3-4 months at a time. Now in her case it is more complicated, because it looks like she has a residence in both countries. Do you still have a house/apartment there where she is going? Is she working there? I can't tell you that there's a specific cut-off in length of time that is "visiting" vs. "residing" - but in your wife's case, IRCC could see it as "returning to reside." it is complicated. In this case, it would be safer to assume that her PCC cannot be older than 6 months at the time you submit your application.

If it is only 6 months and 1 day at the time you apply, submit the old PCC - IRCC will accept that, they do know how difficult PCCs from China are... Unlikely, but if they have a problem with that PCC, you will be informed.

Hi, do you know when they introduced this new rule? We were ready to submit our documents and now with this new rule we will have to request police clearance certificate from Australia and our application will expire... Has anyone have experience getting PCC from Australia? Will really appreciate your replies and comments.

They changed it late last year or early this year, can't remember exactly.

If you have an ITA that will expire before you receive the PCC, I would suggest applying for the PCC from Australia ASAP, and in lieu of uploading the PCC, write a letter of explanation and include copies of your application for the Australia PCCs, and indicate that you will forward them ASAP. Note that Australia processes those pretty quickly.

Also note that if you stayed in Queensland or Victoria, you will also need a traffic history report (or proof that you never held a driver's license there)
