Can I ask my current employer for LMIA in order to apply PR under EE?

Hi everyone, I am new here and have a question about LMIA and how it works.

Can I ask my current employer for LMIA and then use it to apply EE/CEC? Or does an applicable LMIA have to come with a new job offer in order to apply under EE/CEC stream? BTW, I've been working for 1.5 years with the current employer.

LMIA process is entirely employer driven so if your employer is willing to go through all the steps of advertising the job, paying the fees and applying for LMIA then sure.

However, keep in mind that there is no guarantee that the employer will be approved for the LMIA.

So if your employer is willing to give it a try, there is no problem with that

Thank you Andre_Smol. That really helps a lot. One good thing is my employer has posted ads for like 2 months but could not find a right guy for the same position. I'll talk to HR then.

Thats actually good news for you then because if they listed the position on several public sites for 2 months, that will cut a lot of time off the LMIA process as they should already be able to demonstrate that they are unable to find a canadian to fill the job.

Now, if you can get HR on board and have them apply for LMIA and pay the fees, then it just comes down to whether or not they can get the LMIA approved by the government.

Isn't the LMIA fee supposed to be waived when it's in support of a PR application, but I'm not too familiar how to apply or prove that...I just remember reading it around this forum, like this one post from scylla.

That is correct, the fee is not applicable if the LMIA is only to support a PR application.
