Having plenty of problems with ITA and needing help desperately

Hi all!

I have received my ITA about 10 days ago and everytime I try to fill up the form, I feel like crying :(

I'm not sure if anyone has/had the same case as I have. Here are my problems.

1. EE profile marital status: MARRIED. This was the only truthful choice I could make despite being separated. The choices under marital status were married, legally separated, divorced etc. Thing is, we're not LEGALLY SEPARATED. Where I'm from (Philippines), divorce is not allowed and my ex-husband and I have not pursued any legal steps to legalize our separation, hence I stated the truth: I am married.
2. Received ITA: Now, CIC wants info on my husband :eek: and his family (my inlaws) whose dates of birth I have no clue about. My ex-husband, (yes, I refer to him as my ex despite the lack of any legal papers to back up my claim) is from Thailand and is non cooperative on any matters regarding me.

Questions:
What should I do? I feel like I have several options, but I'm not sure if these are the right avenues to take.
1. I can decline my ITA, pull out my EE profile, and create a new one (basically start from scratch all over again and take the risk of not being invited again) I have 474 points.

OR

2. Update my EE profile, change the marital status to LEGALLY SEPARATED (even if this might be misleading, because we aren't separated LEGALLY :(), change my marital status in my ITA to LEGALLY SEPARATED and continue with my application.

There was one thing I tried, just to see what happens if I did: On my ITA PR form, I changed my marital status to LEGALLY SEPARATED and the form for my ex-husband disappeared.
3. Should I continue with this form? Not change my EE profile (with the married status) and simply finish my ITA PR form?

This inquiry is quite long, my apologies. But I am desperate. I tried to contact CIC but they take 30 days to get back at you on case specific inquiries. Your advice/suggestions are my only hope.

If you claim to be legally separated, you'll be asked for documentation. If you claim to be married, you can list your spouse as 'Not accompanying' but you'll still have to get them to do medicals, upload PCC(s) for them and provide POF for 2 applicants.

Recommend that you meet an immigration lawyer in Philippines to see if you can submit an affidavit or some legal document stating your separated status. Along with that document, you should request CIC to exempt you from providing any documentation from your estranged spouse. Such a request is unlikely to be granted but worth a shot.

At 474, you'll get an ITA in almost every draw so you do have sufficient time to chalk out a strategy, get documents in place and apply at a time of your choice. Remember though that your husband will continue to be a part of your application until you are legally divorced. As that isn't allowed in your country, there exists a possibility that CIC might be able to grant exemptions. You cannot be the first applicant from that country applying to Canada with such a family situation. There must be precedents which will be best known to an immigration lawyer who would be the right person to advice you on the next course of action. Hang in there and hope things work out well for you soon enough.

can you get any sort of official paper from church or court stating that you're not living with your ex anymore?

if you declare as married you'll have way too much more to provide than just dates of birth of your inlaws.. like police clearance, medicals...etc.

First off, thank you so much for your prompt reply. I had read it earlier but put it off as I'm not sure how this plus points work. Anyhow, I really do appreciate the help. I have tried meeting with my ex-husband and he seems willing to give me a divorce, but isn't very eager to give me one any time soon. Talk about prolonging my agony. He said he will do it at his own time :'(

I just have one question, now that my 60 days is down to 25 days, were you suggesting that I decline my ITA, delete my profile. and then making another one when all my papers are ready to go? Thank you again...
ps. How do I add points to you? Sorry, newbie here. :D

You can decline the ITA or let it lapse on it's own after 25 days. Once it lapses (or is declined), your profile will be placed back in the pool. You won't be required to create another profile. You can the edit your marital status to 'legally separated'.

Have you spoken with an immigration lawyer? Or searched the forum for other Filipinos who might have faced similar challenges in the past? One possible resolution included getting an affidavit made which formalizes this separation and that can be submitted along with your application. By doing this, you are explicitly excluding your spouse from your application so that you aren't asked for their medicals or PCC. Another possible resolution includes your spouse giving the medicals and PCC as required but being listed as 'not accompanying' in your application. This way, they won't get the PR along with you but continue to be a part of your application. In this situation, you can then edit your marital status if and when you are legally divorced.

I'm alos in a similar situation and have contracted a lawyer to draft legal separation agreement. I don't want to take any chances. should i change my EE profile to separated before i get ITA?

Did you need to input husband detail like passport number or dob if status is mentioned as legally separated in post ITA forum

Hi All,

My name is Shrina and I submitted the PR application as legally divorced.
I have the affidavit and other documents to support my application.

Now when I am submitting my ITA under marital status it shows legally separated but with a follow up question:
Had xyz been previously married or in a common law relationship?

Should I say Yes here or No.

I've been married once.

Is it asking for another relationship/marriage?

Your help would be appreciated.
