Visitor Visa Rejected. Should We reapply ?

My spouse got her visitor visa rejected from NDVO for following reasons:

You have not satisfied me that you would leave Canada at the end of your stay as a temporary resident.
In reaching this decision, I considered several factors, including:

Your history of having contravened the conditions of admission on a previous stay in Canada
Your travel history
Your immigration status
Your family ties in Canada and in your country of residence
Length of proposed stay in Canada
Purpose of visit
Limited employment prospects in your country of residence
Your current employment situation
Your personal assets and financial status
That you have a legitimate business purpose in Canada
I am not satisfied that you have answered truthfully all questions put to you.

options in red + bold are the one that are selected on the refusal letter.

Now my spouse has a good job in india and has a good account balance. She don't have a travel history and doesn't have any property.

Would reapplying with some additional details help ? What else could I include in the application to make it strong ?

I submitted a letter of invitation showing my employment letter, last years NOA, last 6 months bank statements, citizenship certificate and passport. My spouse submitted all forms, purpose of visit, passport, medical, employment letter, last 6 months of bank statements, letter from employer showing 5 weeks vacation(NOC), return flight ticket and marriage certificate.

Okay, here goes:
Firstly, the key reason why her TRV was refused is because her ties to Canada (as she is your wife) + with a spousal sponsorship in progress, are stronger than those to India.... having said this, kriskris you may want to re-apply by addressing the reasons for refusal.

a. Travel History: Cannot do much for this point if your wife has not traveled earlier.

b. Family ties in Canada and in your country of residence: Like I mentioned above, this is the main reason for refusal

c. Purpose of Visit: Again, this is linked to Point b

d. Financials of INR 400,000 (CAD 8000): Typically, one needs to show about CAD 1000 per week of visit + airfare + surplus funds.... so finances for her 5 weeks vacation are falling slightly short of the ideal amount


Some suggestions when you re-apply:
Family Ties: Does your wife live with her/your parents? Are they dependent on her? Do you have kid(s) that will/will not accompany her?

Purpose of Visit: You may want to prepare a detailed itinerary showing places of tourist interest/meeting family and friends, etc with expense estimates that confirm she can pay for her airfare + this itinerary (although you may pay for all of it in reality).... the idea is to show she is a tourist and not just to meet you

Employment: Along with the NOC, you can provide her Employment Letter + last 6 months salary slips + letter stating her job will be there for her when she returns + her role and responsibilities in the team/department (sort of like how she is a valued member of the team, so she must return) + any recognition/certificates from her employer


Apart from the above:
Is she a nominee/Power of Attorney holder for any property owned by her parents or yourself?

Does she live in a rental/leased property? Or is it a property owned by you/your parents or her parents?

Finances: Does she have FDs, RDs, mutual funds, shares, PF, EPF, LIC, etc? Gold Jewelry - she can do a self evaluation of it or from a jeweler and add this amount to her Financial Assets.... she must show Total Financial Investments (locked-in or available) + Liquid funds for the visit

Is there a possibility of her being sent abroad through her employer for any short-term project, conference or training (any country)? Of course, this will add to the time frame for applying for the TRV.... but it will give her travel history

Can she provide evidence that she must return by XX date for company project, attend a training program, appraisal, possible promotion and salary hike, family event, employment bond, etc?

Did you purchase confirmed tickets? Or was it only a travel booking?

Is it possible for her to visit her brother in Europe after she visits Canada (same route)..... if she can get a visa to visit her brother.... then she can show that she must leave Canada to meet her brother on the return trip.... this is just a thought


If you can provide more details for the above then we can give you more suggestions

- She lives on her own as she is working in Delhi. Parents are not dependent on her. No kids

- We created a list of places that we are going to visit with dates covering her trip. Didn't give expense estimates though.

- She added the employment letter and added salary slips. This type of letter is almost impossible to get as their HR follow some strict policies about what they can or can not write on the letter. She have some certificates from her employer but didn't add them with the application.

Apart from the above:

- No property at her name and not a nominee/POA

- She lives in rental property. It is not owned by any of us.

- She have gold jewellery. We didn't do the evaluation of that. No other assets.

Hi,

A couple of additional points that you may want to consider:
a. Lease Agreement for the place she is staying at.... especially forfeiting the deposit (if that's the case)

b. Any emails/documents from her Manager/team mates about her work/responsibilities/ongoing assignment..... so you can bypass getting a letter from HR for this

c. Stress on the confirmed return tickets which shows every intention to return.... versus tentative travel bookings

d. Again just a thought: If she visits her brother.... and if it is possible for you to accompany her..... as you will leave Canada for the side trip, she must leave Canada too.... this same logic will apply to a side trip AFTER her visit to Canada (for eg) to the Cuba cruise before she returns to New Delhi

You can reapply anytime as soon as you address the reasons for refusal.

My advice is do not only address the reasons for refusal but go beyond it by proving (in every way) that she will return.... and she will not overstay when her sponsorship application is in progress

Hi Bryanna,

I am from India and have got my PR recently, will land in late July. I have applied for my mother’s visitor visa so that she can come along with me for initial 10-15 days, however, the visa got refused with the followimg reasons

Your travel history - (she has travelled to thailand only)

Your family ties in Canada and in your country of residence

Purpose of visit - to travel along with her son and help him in settling up the house and other stuff.

Your personal assets and financial status - she has a property on her name, the relevant papers were attached. She has also shown a fixed deposit of about 50000 CAD.

She is a retired govt employee and also has attached the pension documents.

I am quite worried about it as she’ll be all alone once I leave for Canada.

1. Could you please suggest what could be the main reason
2. What all things we should keep in mind when we re-apply?
3. When can we re-apply?

IMO, this is the main reason why your mom was refused. It would seem like she is permanently moving to Canada with you instead of her visiting.

And, based on your post, I'm guessing your mom does not have any immediate family ties in India to return to i.e. no spouse and no other children who live with her.

I recommend you land as a PR and settle in (find a job, place to live, etc) for a few months before your mom reapplies. Do post the list of documents on here before reapplying

Thanks for the reply, yes she doesn’t have an immediate family ties as I have a sister, however, she is married and lives with her husband. Will this be again a reason to refuse even if I apply after what you have suggested?

Your married sister won't count as family ties to return to. Your mom's family ties to you will outweigh her family ties in India + by stating she wants to help you to settle in (wasn't a good idea) has not helped her case. That's why she must prove she has exceptionally solid ties to return home

Thanks for the reply. In that case there are no family ties in India, the only thing we can show is property, funds and the pension she is getting from her employer. Quite worried and confused what to write as a solid reason.
