Spouse open work permit denied after receiving Post graduate work permit...

Dear Sir or Madam,
My spouse had an open work permit while I was studying in Canada. Once I applied for the post graduate work permit, she has also applied for an extension of her open work permit. We did that couple of days before both our TRVs and permits expired and received an answer that my PGWP is approved but my spouse's open work permit denied. And just to mention, that both of us are currently in Canada.
Even before applying I had a job offer in the job on NOC A list (4165) I started working 1 month before our visa expired and is to continue in the future (though it is not a full time job). We sent that all documentation to CIC and she received an answer that there were insufficient information to prove that I have a job in the required NOC category. Job offer we have sent them included all the important elements: starting date, ending date, responsibilities, pay, working hours except for the position title. In her refusal letter, they said that we could reapply if we can substantiate with new evidence. In the meantime she lost her TRV status, so the question is: should she re-apply for open work permit now clearly indicating my NOC title and category, or should she go for the restoration of the status since from today she has no status in the country or should we appeal and in that case what channel to use?

If you have been refused once - what ever the reason and your status expired, then you have to apply for restoration of status.

Hi ,

My name is Chhaya and i work for a private company in new delhi, India since year 2011. I recently got married in january 2014 and my spouse currently holds a post graduate work permit visa valid until 2017 and is a an IT professional- server administrator which comes under skill level a, b, c and I have travelled to canada on a TRV visa and returned bak to join my office. I understand that i may be eligible for an open work permit which takes 4 to 5 months for processing , i would like to know if i can apply for a tourist visa simultaneously and travel on the same until an outcome for open work permit is received if not can i just apply for a tourist visa and lodge the open work permit ( dependent spouse) once i reach calgary, canada as i plan to resign from my job soon

Grateful if u can help me with this query at earliest
