Im from the philippines & I got married Dec. 2009.. My husband is a PR holder.. He is going to file his sponsorship this month..
But I had a 3 yrs old son & not his legitimate child.. Can I bring my son with me even though my husband is not his real father?
I need some advices please.. Thanks.. :)
 
you will have to have full legal custody of your child and have a medical test performed as well.
 
All applicant and their dependent children need to do a medical examination, so you and your child will need to do this.
 
You will need the childs father to fill out form imm5406. Here is a link to the form http://www.cic.gc.ca/english/pdf/kits/forms/imm5406e.pdf You also must have court documents showing that you have full custody.Medicals and photos.
Even though you have full custody if the father has visiting rights then you wont be able to take the child from the country with out a court saying you can.
 
Even if It stated on the chiLds birth certificate that his father is "UNKNOWN".. & I don't know where his father is &
we have no communication at all.. Thanks for all the infos.
 
If it legally states on your sons Birth Certificate Father "Unknown" then I cant see there being a problem as there are no legal implications as far as parental rights for the father..as in the eyes of the law your son doesnt have a father..
 
Your husband is eligible to sponsor you and all of your dependent children - "legitimate" or not. You have to be able to prove that you have full physical and legal custody of the child, though, for you to be able to bring him to Canada without written authorization from his birth father. If you do not have a court order that verifies this, get one before you submit the sponsorship paperwork. In the end, even if it takes extra time, it will make your process a lot less complicated. If you submit the application before you can prove that, you're only setting yourselves up for long delays and possible refusal.

Yes, your husband can sponsor you and your child. Make sure the child is included on the forms - if your husband doesn't include the child on the forms, you won't be able to sponsor the child later.

Well im not sure about the UNKNOWN on the birth cert.I was just going by what immigration told me and my wife as she has a 4 year old and we had to get a lot of forms done before she can bring him but like i said we know who the father is.SO if you have court papaers stating you have full custody and the father is UNKNOWN then its hard to get the forms immigration wants,so i guess you should be fine.

This is the form we needed signed http://www.canadainternational.gc.ca/iran/assets/pdfs/visas/30_1_eng.pdf but i guess you cant get it signed
