Change of Status from Student to Worker

Hi All,

My wife and I came to Canada on Study Permit last month. Now I am planning to withdraw from my course and to change my status from Student to Worker (since my wife has valid study permit hence, I believe I would be eligible for Open Work Permit as dependent). Please let me know if there is any issue in changing my status. Also what are the steps I need to follow to achieve this.

Which option should I select on Form IMM5710:

•An extension of a work permit with the same employer
•A work permit with a new employer
•Restoration of your status as a worker
•An initial or an extension of a temporary resident permit

Hi there,

Please note that you came to Canada for studying and your status is as a student - under Study Permit as an International Student. Now you have to study full-time and complete your studies. You can only work on-campus. You have to wait at least 6 months before you can apply for an Off Campus Work Permit (OCWP).

You cannot simply change your status at this time. None of the options you mentioned will work as Canadian personnel authorized you to stay in Canada only for the purpose of study. Your only option is to complete your program of studies here or go back and apply under any other category.

you will have to apply for change of condition within canada

also when selecting those options u can select work permit for new employer and later down the line in the form there is an option for open work permit. U can change ur status......

Please check the Guide 5553 under the section of "Determining eligibility".

Normally, a work permit must be applied for prior to coming to Canada. Only in a few special circumstances presented in this guide can an initial work permit be applied for within Canada:

If you are a temporary resident, such as a student, who wishes to work, you must apply for and obtain a work permit before actually starting to work.
This means you have to apply for either an Off Campus Work Permit (OCWP) or a Post Graduate Work Permit (PGWP). For these options, you have to be in a student status and complete some level of studies here.

Read the OP's post again. His wife is here on a study permit as well. He can therefore switch to an open work permit as an accompanying spouse.

Wow! This is new to me. Few points should be taken into considerations:

1) Both the members are on a study permit.

2) The quote that your you provided, a line before that mentions about the eligibility criteria:

Important: The ability to apply in Canada does not guarantee acceptance. Eligibility criteria for the category of work permit must be met.
I have provided the link for eligibility criteria in my previous reply.

3) As per your quote, a person with a study permit can apply for work permit. That is exactly what I mentioned in my previous response. You can apply for OCWP or PGWP on the basis of your study permit. And both of the permits depend on the standings based upon your institute's feedback.

To summarize that, maybe you can change your status from student or worker without studying but you should always consult with your school's international student advisor about that.

very wrong OPs wife is on study permit so he can apply based on a dependent of a study permit holder and not on his study permit. So OP's study permit will be canceled and he will get Open work permit and not off campus work permit or post graduate work permit. His wife is on a study permit as long as she stays on study permit OP can apply and qualifies for open work permit . ur not getting the point ur stuck on OCWP or PGWP but in this case OP qualifies for OWP.

Thank you for clearing this up. I was under the impression that both of them are on a study permit. I wasn't "stuck" on the work permits, I was just having a discussion as per his situation. :)

yes both of them have a study permit so either one of them can discontinue his/her study permit and go on work permit as long as the other stays on study permit.

Thanks a lot Mead and others for your guidance. I consulted a lawyer and he confirmed that I can apply for work permit based on my wife's study permit. The process will take around 8 weeks. Shall keep everyone posted how it goes!

I applied for Dependent work permit and got it. Again I renewed it this year. Your work permit would be valid till your spouse's permit is valid. I submitted form IMM5710.

My spouse is on Post Graduate Open Work Permit right. What are my chances to get Open Work Permit as well at the same time with her? Can you explain how is the process gonna work out? I heard a lot about being on dependent spousal work permit while he/she is studyin, but how about when they are already on work permit?

Hi, I am in the same situation and was just wondering whether you had to officially withdrawn from school before submitting the IMM5710. My spouse is also a student and wants to quit school and start working. Did you apply for change of status and then withdraw from the program after?
