PRTD on H&C basis apply to sponsor spouse

Dear all,

I have been outside of Canada for 5 years. I came back to Canada since Dec 2024 by PRTD code R-1. But I got Gcms notes say that my PRTD was granted on H&C basis. My concerns are:
- Can I go apply to sponsor my family without waiting 2 years +. (Probably 1 year from the day I came back to Canada because I want to be employed for a while ( 8-9 months being employed) before apply for sponsor to meet financial requirements.
- How long I have to work in order to meet financial requirements for sponsorship? I have some saving in bank account (~ 20k). My wife have some saving in her account as well.
- Can I sponsor by using expired PR card?

-I think both applying for a new PR card and sponsoring your spouse are fine, as long as you remain in Canada during the process, as you have evidence it was an H&C basis renewal.

But I do not know how best to document this in your PR card renewal application (no need to in sponsorship app). I'm also not 100% certain - but on balance I think any risk (which I believe is small) compared to waiting two years is far outweighed by your family situation. Welcome the views of others.

Your other two qustions I'm quite certain about: there are no specific financial requirements, and your expired PR card or even old COPR is sufficient for purposes of sponsorship.

Thank you very much for your advice. I am currently in Quebec and the processing time for sponsorship is 36 months. I am thinking of moving to other province to apply because processing time is much shorter which is 12 months. What if I work in Quebec and live in other small town not belong to Quebec.

You'll want to give it a bit of time, say a couple of months, to show you're indeed living in the other province (eg Ontario). Don't play games with sort-of living in another province.

But if your question is, does residing in province A while working in Quebec mean you are a resident of A for purposes of sponsorship - the answer is yes.

A minor add, I forgot to say to update all id, healthcare, cra, etc, to address in new province.

And I assume work and residence are reasonably close. No games like residential address ten hours by car from work.

(Sorry to even say this but there have been cases)

Are we talking about living in Ottawa and commuting to Hull or Gatineau or are you talking about living in Ottawa yet declaring you work in Montreal? Is this remote work? How long have you lived in Quebec? For example if you declare you are living in Ottawa but declare you work in Montreal that is not a normal commute and there will be concern that you are likely living in Quebec at least part of the week.

Thank you for your reminding me. I understand that things need to be reasonable. Work and residence cant be too far.
BTW, I just got a call from this number 1(888) 242-0120. Its automatic voice call claiming that a call from IRCC try to contact me multiple times and ask me to press number 9 to continue but I hang up. Is it really IRCC or some sort of scam. IRCC number for applicant to contact is 1(888)-242-2100 which looks really similar to the number called me. Thank you.

I currently work in quebec. I want to move my residence to somewhere just a bit outside of quebec but i am still able to drive to work ( around 45’-1 hour drive). Thank you

You’re playing with fire on various levels. You’re clearly trying to avoid processing in Quebec while keeping significant ties in Quebec and sounds like this would be a very unusual housing arrangement for someone who works in your location. You also arrived on a PRTD and are also trying to sponsor your family without meeting RO and not even close to RO. Do you plan to move back to Quebec?
