Hello,
I plan to marry a Colombian after 3 years of dating. Her tourist visa was denied twice (with sponsorship proven) as government indicated that they are not convinced she will return. (She is well traveled throughout SA and Europe.)

In the near future, of course, I want her to be with me in Canada at least half the year. I'm a business owner and very shortly, WE will be business owners bit yet she has no right to be in canada even as a tourist. We will apply for spousal visa.

While we wait for visa processing , can our business sponsor her for an LMIA to work in the meantime or can she legally earn money from a restaurant that she is part owner of?

Get married and sponsor her outland. For LMIA, must be high wage and you have to post the job on Job Bank and other sites and prove no Canadian has the education, work experience and language skills to do the job. Then if LMIA is approved she can apply for a closed work permit with ECA and IELT/TEF. Your business has to be eligible for a LMIA too.

A LMIA for a restaurant job will have almost zero chance unless she has RED SEAL as a chef.

Don't try to trick the system. Just wait till you get married and sponsor her outland.
