Pending Criminal Charge, please HELP.

I currently have a pending charge in the US. How will this affect my eligiblity to enter Canada? A deportation order was issued due to these charges and I was unable to appear and settle my case. Now I am married to a Canadian PR and we were wondering if it is possible for me to enter Canada with her as my spouse sponsor?

Also, since I probably have a warrant for my arrest in the US, will this mean I have a valid warrant in Canada?
Please help! Thanks!

It depends on the charges/crime you are wanted for. You probably have to apply for pardon/rehabilitaion before you can apply for PR.

Depending on the charges, if the US authorities have put out an international warrent, you will also have a warrent out for you in Canada.

Thanks a lot GK, The crime was a felony "Theft by Taken", and as far as I know from what my criminal lawyer told me is that the warrant was only issued in 1 state. This was my 1st offense, Lived in the states for 10 years and never had any problems.

So how do I go by applying for pardon/rehabilitaion in Canada?

I received our PR this January 2025 but prior to the approval my husband has been charged with grave coercion las September 2023 and there is no decision yet as no schedule for hearing. Can he still enter Canada? We are planning to go on July this year. Please help us, I am totally blank on what we will do.

This situation is not clear. Did only you receive PR through spousal sponsorship or did you both receive PR together?

Apologies. I mean we received our PR visa (me, my husband and my daughter). We are planning to travel this July, do you think there will be a problem since there is a note in the ECOPR that my husband has been charged to an offense. Thank you.

I would get advice from a Canadian immigration lawyer. Normally ECOPRs aren't issued if there are criminal charges pending. I don't know the answer.

or just because the case is not yet been started in court? and theres no verdict yet because the supposed to be hearing this March was reset and we dont when would be the hearing as we didnt receive any calls. Anyway, thank you for your reply. Appreciated.

If there is an open case IRCC will normally not issue COPR until the case is decided.

Getting advice from an immigration lawyer would be the advice.
BTW this is not family class sponsorship.
Your question is related to PNP.
