Foreign Work Experience Misrepresentation and PR Application Rejection

Hi everyone,

I recently received an ITA under the CEC category and included my foreign work experience in my profile. However, I did not disclose this experience in my previous work permit, study permit, or any extension applications. After receiving the ITA, I uploaded supporting documents like bank statements, pay stubs, reference letters, and my offer letter. Unfortunately, the Visa Officer (VO) was not convinced that these documents were legitimate and requested additional documents, including tax files from that time. I provided a statement from a colleague confirming my work at the company, but despite this, my application was rejected, and the VO flagged it as misrepresentation, resulting in a five-year ban.

I will be consulting a lawyer to explore my options and will keep you updated. My advice to everyone is to be very careful when claiming points for experience that might not match your previous applications. IRCC is very strict in these matters, and the whole PR process is highly scrutinized.

Did you attach a LOE the first time mentioning the reason for not including the foreign work experience in your previous applications? Any reasons why you didn't mention them? You may try to over turn the 5 year ban, however, it's important that you get a very GOOD lawyer who knows what needs to be done in your scenario.

This is because many would not have qualified for the original study or work permits. Purposely leaving out previous experience to get one permit gives you an advantage but you can’t suddenly claim the experience when it is now beneficial to you.

I have mentioned foreign work experience in study permit but didn't include in PGWP application and TRV, the main reason is I didn't know that it is mandatory to add. I didn't even add that in PNP application which is now approved. Now I have added that experience(in personal history section) in PR application but I am not claiming any points. Do you guys think it will create any problem in PR application? Please answer my question.

Just attach a LOE and you should be fine since you're not claiming any points for it. They usually check everything under a microscope for the ones that you claimed points for.

I have genuine foreign work experience, I did not disclose the work experience at that time due to my limited knowledge of each application. Now, I am claiming point for my foreign work experience for which I have attached reference letter, all the paystubs, official tax documents along with LOE for not including it in my previous applications. Do you think this would suffice?

You did the right thing by attaching a LOE. However, accepting it or not is totally at the discretion of the VO who'll be reviewing your file!
