Refusal Grounds: R179(b) Inconsistent Purpose
Print Sequence: 3
Description: The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.
Comments:
  • I had mentioned that I as the sponsor would take care of all the expenses. Above, Refusal Grounds: R179(b) Assets, whose assets are they talking about -> mine or my mother's?
  • In the starting section of the notes they've listed Available Funds (CAD) : 7500 What does this mean ? Not sure where they got this from. Does this figure have any bearing on the decision?
-------------------------------------------------------------------------
I have considered the following factors in my decision.
Insufficient proof of funds/establishment for PA
The applicant's assets and financial situation are insufficient to support the stated purpose of travel for themselves (and any accompanying family member(s), if applicable).
The purpose of the applicant's visit to Canada is not consistent with a temporary stay given the details provided in the application.
Weighing the factors in this application, I am not satisfied that the applicant will depart Canada at the end of the period authorized for their stay.
For the reasons above, I have refused this application.

Is there something more than what meets the eye here?
What does establishment for PA mean?

As a visitor you are typically required to show your own funds. What ties did she show to her home country? Has she travelled internationally before and when? What is her citizenship?

I had shown some funds in her account but it was less. I have shown my salary slips, employment letter and bank accounts in Canada and US.
However, I was less than 6 months in Canada, then, and did not have my T4 or NOA

What ties did she show to her home country?

Family ties.

Has she travelled internationally before and when?
No

What is her citizenship?
Indian

Ties to return are job letter with approved leave, business registration and income properties. Family ties can be spouse and minor children.

Your funds/job are not relevant. She needs to show cash in the bank. So funds will depend on her length of stay so 2-3 weeks, 10k cash is a good minimum. Once you say sponsor all expenses then that means she cannot afford visit. You think there is “more than meets the eye” but there isn’t because she didn’t show enough of her own cash in the bank.

Her eligibility failed because she didn’t show ties to return nor her own money and relying on you.

Chinook is IRCC’s screening system to see if even eligible or not. She failed - no ties to return, no money and no travel history.

How long was visit? What did she show to return?

Ties to return are a job letter with approved leave, business registration and income properties.
She is a farmer and doesn't have any such official documents.

How long was the visit?
2 months

What did she show to return?
The purpose of the visit letter mentioned that she would return. Thats all.

Not that I'm applying for Super Visa, I'm planning to show
For my Mother
- Around INR 16 lakhs in her bank account.
- Property valuation from CA with a net worth of about 2 CR (along with documentation and evaluation of agricultural and residential properties)
- Letter mentioning the farming and social activities that she's involved in back in India.

For myself and Wife
- Around CAD 50k Savings
- Bank Statements (Last 12 months), T4 (Last 2 years), NOA (2023), Employment Letters, Pay stubs (12 months)

What else do you think should help strengthen our case?

Two months is way too long. Property valuation/social activities are not ties to return. She needs to show that she is a farmer that must return to tend to her farm. Letter not enough. Income and taxes paid as farmer/invoices/receipts/business registration etc.

Don’t know currency exchange but if that is $26,000 in cash then may be enough. Your funds not relevant unless applying for a supervisa and given length of visit and refusal for lack of funds then that may be a better option. Then funds are based on your NOA.

Yes. Now I'm applying for a Super Visa.
And Yes, she has CAD 26000 in the Bank.
In this context, if you re-read my previous statements, what do you think ?
-
A 2 month long visit was way too long, and would want to show more funds for that long of a visit. If you want her to stay months then apply for supervisa. She has to pass medical and get a year of insurance.
