Help please. Spousal sponsorship issues

Hello everyone.

Please assist any information about this scenario.

I was a student in canada. I got PR in express entry. Then during my PR process, i travelled to India got married. I got my first PR finalizing email (portal 1 email) on March 2. Five days before my marriage. I informed IRCC i was outside canada. Got married on March 7. Returned to canada.

I had a representative helping me with my express entry so i asked if I can update my wife through a web form. She said No.. trusting my Lawyer. I updated and got ecopr and PR card.

Then months later in august I filed for spousal visa. Sponsor eligibility was succesful. Bio metry,medical everything completed and updated. Now on Back ground check, iRCC is raising questions why I did no declare my wife during the period March 7 to April 2(ecopr date) . So because i dint declare they are raising paragraph 101 7(d) where my wife is excluded as my family member.

Reached out to representative, they agreed to give a reference letter and i am thinking to give an explanation admitting the mistake including whatsapp chat with my representative talking about adding and being advised no.

I made a mistake. Regret it. Was under influence of consultation received. Now worried if my wife will be banned for 5 years or can never be sponsored. Anyone with any similar experiences or sugestions. Pls respond. Have 30 days to respond.

Is your consultant a Canadian-registered immigration consultant? In Canada? If so, you should report them.

As for your question: if IRCC accepts your explanation and decides to be lenient - she would likely get approved. If not - can never be sponsored by you.

Yes. Representative was registered in canada. She offered to help with a reference letter admitting the mistake. All i have is that from her and an explanation to IRCc that I made a mistake not knowing it. But yes i made the mistake. Not being able to sponsor her is huge for us.

Is this okay ? 2 files in total

1.Explanation letter from me as sponsor (along with attached letter from Representative)
2. Another letter from my wife, principal applicant that this confusion is caused by sponsor me and representative due to lack of knowledge and bad advise given as a request to the officer to show mercy.

Despite the mistake of the representative, it's your responsibility at the end of the day, unfortunately, it won't likely be considered by IRCC.

Be sure to report her to the registration authorities - she should lose her license (or whatever it's called) for this advice.
The consultant won't lose her license for that and "reporting" won't definitely help anyone in this case. On the other hand, the fact that the consultant is cooperating will help much more.

Idiot consultants who provide bad advice like this absolutely should be reported - for precisely the reason the system exists, to protect the public from incompetence and bad actors. It might be wise for this applicant to wait and see what happens to the file from IRCC before doing so.

The consequences of bad advice are serious. And as a result, their disciplinary committee certainly does have the power to suspend and revoke a member's license.

Whether this kind of rank incompetence will merit that type of punishment - that's up to them.

Update:

Responded to PFL on December 4,2024. File was transferred to local visa office in New Delhi on December 19,2024.

No update ever since.

Also made a complaint to CICC against the representative which was in favour of me.

Currently waiting for God's miracle. Praying to the god to do his will.

Tensed about the timelines.

I raised that query to my current immigration lawyer. They said to wait at this point. As the response time for PFLs are 90 to 120 days. I check tracker every day. That part feels so bad.

I saw a ghost update on tracker on Jan 24. Tracker says updated on Jan 24. But nothing is on it.

Does that mean someone is working on it ? Or is it just random update?

No-one can say for sure, but probably does mean someone at least opened the file.

Up to you when to order gcms notes. I won't argue with your lawyer's advice - and glad ot see (in this instance) that you have one.
