Hello,

So I applied in 2019 to the pool to sponsor both my parents, back then I was with a common in law relation (just a girl friend, no marriage, no kids), so she was a potentiel futur co-signer (just in the interest form, but when I was selected in 2023, I did not put her as a co-signer since I was single, so she was never a co-signer in the application) with me as well (even though I did not need her, since I exceeded the minimum financial requirements, please do not judge on that, its the past ...).

When I got selected in the pool in 2023, we were seperated (so I was single again), did apply officially to IRCC just myself, and put an explanation letter obviously and just my documents since I were single ( I am still single), and again obvisouly I was fullfiling the financial requirement even by being single + 2 parents = so family member number is 3 !!!

They check 2020, 2021 and 2022 years for money, and the officer this WEEK, HE BASED HIS CALCULATION ON A FAMILY OF 4 !!!!!! INSTEAD OF 3, like he count her even though we are not in a relationship anymore, and I did not ADD HER income ANYWAY in the official 2023 application ... CONSEQUENCE I do not fullfill requirement for 2022 based on 4 people, BUT WE ARE ONLY 3 + I did not add her income obvisouly since we are not together any more. AND YES I DO fullfil financial requirement for 3 PEOPLE so me and both parents for all the years.

So last week officer sent letter than i do not quality for 4 people and they will cancel my application !!!!

He obvisouly made a mistake, I need some legal texts and acts on IRCC to show him, he is wrong, but I need texts, proof from IRCC website or somethere to challenge him ASAP please : (

This does NOT make any sense, to add my ex in our family, knowing that she is not family member anymore + her income was NOT included.

PLEASE I NEED YOU GUYS.

I have contacted my MP and send emails so far. But need some solid text from IRCC that will put him at wrong doing and put my application back

But when did you separate as common-law because you are a family of 4 for the years you were together. Plus she co-signed.

Okay so she counts as your total family numbers from 2020-23, and possibly most of 2023 depending on separation date. She was still part of the household so you are only a family of 3 from 2023 onwards.

I think to ircc you are still considered common law until you change it with them .I am guessing you never told ircc you are no longer common law.They never know your current situation unless you tell them .
I never said that.

We were already separated when I officially applied in 2023, so they had me single when I applied officially in 2023 Dec.

Okay so she counts as your total family numbers from 2020-23, and possibly most of 2023 depending on separation date. She was still part of the household so you are only a family of 3 from 2023 onwards.

She was a potentiel co-signer in 2019 (interest) that is, when i was selected and i officially applied to IRCC in dec 2023, I was single and it was only me in the application, so NO co-signer.

Hire a lawyer for your best chances of fighting this. There are legitimate grounds for refusal because you were a family of 4. Given that your common law partner is no longer eligible to co-sign LICO will be based on your income alone.

LICO is so low to begin with if you can’t meet LICO for 4 people I’m not sure how you can afford to support 2 other adults likely seniors in Canada with the COL. If your parent ended up in LTC how would you afford the around 2.5k/month bed fee that you’d be required to pay for the next 20 years (10 years in QC)? Just food and housing would be difficult to pay for if you add 2 more adults.

Interest to sponsor form (back in 2019) did not ask for co signer at all. It only asked you to provide the names of parents/Grand parents and your PR/passport details but they did not ask about the co signer at all.
So either you have your partner names somewhere else in cic documents and that is why they treated as family of 4.
I will suggest to check all the documents you submitted to CIC and definitely, it has a section where you declare that you have/had spouse/partner so you might made a mistake in declaring it properly.

Also, the note above is correct that if you separated in 2023, your income requirement should meet for the family of 4 for the years 2020,2021 and 2023.

I will suggest to seek a professional help but I just wanted to clarify that family of 4 is not coming from co-signer in the interest form.

You need to speak with a lawyer. Based on my understanding of the rules, IRCC is correct in having applied the family size of 4. The same would be true if you were married during this time and then were subsequently divorced. An ex isn't going to be a cosigner. I know that feels contradictory but those are the rules. I'm not sure you're going to be able to turn this around.

Being a family member (common law partner) doesn't need to be a co-signer. That's 2 separate issue.
e.g. a wife (in Canada, a common law partner is almost the same as wife) will count in the family size. BUT the wife doesn't have to be a co-signer for PGP application.

Anyway, seek help from a lawyer. Officially, you need to meet income for 4 in 2020-2023. But IRCC may allow if your lawyer can justify or ask for an exception. (I am not sure)
