Inland spousal sponsorship with failed refugee claimant

Here's my situation:

We have sent an inland spousal sponsorship request for my husband who is a refugee claimant. This is our timeline for now.

Application submitted on June 28th
AOR on July 31th
CSQ request sent on September 6th
Biometrics on September 17th
CSQ granted on November 22th
Pre-arrival on December 20th
AIP on December 27th
SA on December 28th
Background in process

Now, the thing is that he just had his audience (yesterday) and we're waiting on the answer but are almost 100% positive that he will not be approved as a refugee. We have sent the request before his audience so it plays to our advantage but it still leaves us in a vulnerable position. We have a lawyer and a strategy laid out to buy more time (RAD appeal, H&C, PRRA, deferrals of removal) but it's still uncertain whether things will go as planned. The delays are also ridiculously long in Quebec which makes us even more nervous and doubtful of how much time we can truly get. I was wondering if anyone had a similar experience and could share a bit about it. I know that it all comes down to what CBSA agents decide but I was wondering if there was anything we could possibly do.

Thank you!

If im not mistaken the fact that he got AIP means he’s safe. That’s the only thing that’ll let them wave a removal order is AIP and you guys got that already so the spousal sponsorship is going to come through soon you’re on the final steps.

What is your question exactly?

You seem to be asking, basically, what are the chances he'll face serious issues with cbsa i.e. will they try to remove him if the refugee claim is refused.

Probably low. It takes some time before they do anything (usually). But if you have a lawyer - ask the lawyer.

If your lawyer does spousal sponsorships as well, they should know whether in such cases would typically benefit from (essentially) from forbearance - meaning cbsa just leaves it alone until the spousal sponsorship is complete.

Quebec issue doesn't help, obviously.

Make this system make sense. Taxpayers are paying a small fortune to process an asylum claim that appears to no grounds and potentially RAD, JR, H&C, PPRA, etc. to keep someone in the country while their spousal sponsorship is being processed. We also may be paying legal aid as well‍. This system needs reform asap.

Yes with our huge provincial and federal deficits spending thousands if not ten of thousands of dollars for no reason makes total sense.
It’s ridiculous

And it’s blatant in there posting . Let’s file everything imaginable even if they aren’t qualified

…..and god forbid the taxpayers complain

I guess I don't have a specific question but was wondering if anyone has had a similar experience. I've been searching for such information but couldn't find much on the topic..

It's the lawyer that helped us with our spousal sponsorship and he's the one who will help us with the rest. He seems to be telling us that CBSA generally takes ongoing sponsorships into consideration but he still remains vague as to the possible outcome probably because, well, he doesn't want to get our hopes up.

Now that I think about it, I suppose my question would be: How much time would CBSA generally give you ? A few months? Until your case gets its final decision ?
