Hi guys,
The date I submitted my refugee claim was when my eldest children was 21 years old who is 6 months away from his 22 years old birthday. But at that time he already having a full time job. And then I had positive hearing and submitted pr application after he turned over 22.
My question is will he still be eligible for being a dependent under this circumstance?

I’ve been reading this website for a long time as it states two points as follows,
  • Check the age of your child at the time we or the Canada Border Services Agency (CBSA) received your refugee claim. This is the age we’ll use to check your child’s eligibility, no matter how old they are during processing.
  • Make sure your child meets the age limit and requirements in force at the time we received your application for permanent residence
  • The first point is apply to my case, but about the second point does that means the date of submit pr application? That’s where confuses me.

Did you mention your dependent name while submitting BOC.

It is the day they received your complete refugee claim. that is locked in date. So if your child was 22 yrs on that date, He is only eligible provided below conditions for Dependants over the age limit are met.

Who you can include as a dependent child on an immigration application

If you want to apply to come to Canada as a permanent immigrant, or to work, study or visit, you may be able to include dependent children on your application.
Children qualify as dependants if they
  • are under 22 years old and
  • don’t have a spouse or partner
Dependants over the age limit
Children 22 or older qualify as dependants if they
  • have depended on their parents for financial support since before they were 22 and
  • can’t financially support themselves because of a mental or physical condition

Thank you for your reply! My child was under 22 years old when I made the refugee claim. So with this case he may be eligible. But at that time he’s already working full time, does that will affecting his application? As someone said he needs to be in school.

He is eligible, provided he was under 22yrs old when you applied
