Hello everyone! As the title states; I am a citizen of the U.S and my husband is from Canada.

We've recently been scheduled on short notice to appear in my home state's consulate office in NYC. I don't live there anymore; he is working outside of NYC and I know they don't care. I emailed them asking for Zoom or Teams interview but has anyone had any luck with being approved for a Teams/Zoom interview?

My questions are as follows if anyone here has been through this with their partner and how difficult or easy was your experience with them? If anyone from NYC can chime in I'd greatly appreciate it.

1. I heard they don't usually schedule interviews unless there are red flags, i.e not real marriage etc etc.

2. They're requesting additional documents that don't exist, for example I put down my husband had a former common law spouse partnership in accordance with Canadas Charter laws but they WANT a divorce certificate and time is ticking before my application is rejected for this additional document they are requesting.

They're also asking for police background checks in states i worked remotely for but never lived in. The problem with this is the length of time it would take to get them in person because they don't operate online, would take so long my application deadline for submission of documents would expire before I could even get them. It's almost like a trap... help. anyone?

I emailed them multiple times citing these requests that would reject my application but haven't gotten a response. I am freaking out, it's been over 2 years and we don't know what to do.

While someone responds to you with their experience or insight about NY interview process, here's some thought on a lighter note.

If you are a US Citizen, you should not worry - You won't need this interivew or any PR or Citizenship in few days. Do i need to write more than just ....Happy New 51st state?

It's really quite unusual for Americans to be required to attend interviews. I'm not sure you'll get a ton of responses based on that. Yes, interviews are scheduled when they have concerns. Have you already ordered GCMS notes already?

You say your husband was in a former common law spouse partnership. Which is it? It cannot be both. Either he was married or he was common law. I'm wondering if the language you have used has confused IRCC. If he was just common law and did not have a spouse, I would recommend you clarify that and state he was never married prior to marrying you. You could consider having him provide an affidavit to that fact.

Request all of the state certificates that have been requested. When you respond to IRCC, clearly indicate which states you have never lived in and simply worked remotely. Also indicate that you have requested the certificates but that processing times will be longer than x days. Request and extension of x days to submit.

I don't know if they will move the interview or do it online. Are both of you being asked to attend? Where do you live now?

Yes, it's unusual. Minor thoughts:
-I have no idea what you mean by "Canadas charter laws" with respect to common law/spouse partnership. If you wrote something like that, you may have confused things.
-Bluntly, ask/confirm with your spouse that he has NOT been married before. This is important. (There have been cases here of people's spouse's not being clear about this/thinking it didn't count/etc).
-Do I understand correctly that he sponsored his previous common law spouse? How long ago? Any overlap with your relationship/how recently were you married? Has he changed his profile to single with canada revenue?
-Otherwise, answer is obvious: whatever confusion, there is no divorce certificate possible if it was just common law. He could offer to or simply provide a sworn statement that the relationship is over.

It seems possible to me that he applied to sponsor you when he was still under some restriction on sponsoring a new spouse.

What do you mean it's been two years? You've had your application pending for two years?

FYI - looks like the OP is a Quebec applicant so timeline is normal.
