Hello, in light of the new family reunification policy introduced by minister Fraser: please post here, only if you submitted as spousal TRV with AOR:

I applied for a visitor visa to my wife to Abu Dhabi

TRV application submission date: December 8, 2024
TRV Refusal letter: December 11, 2024
Refusal letter: The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.
GCMS notes request date: December 12, 2024 and still NO REPLY

I'm thinking of talking to a lawyer and make an appeal case in the court.

Anyone has the same situation or advise ? Please let me know what to do.

wait for GCMS notes. they have 30 days to give them. it's not been 30 days yet.

then: Based on GCMS notes, it's probably better to reapply addressing the concerns of the officer in the GCMS notes. According to imm lawyer I spoke to, in the case of choosing to appeal, it can drag from 6 to 12 months. He could be wrong. As he told me it takes 8 weeks to get PR AOR, but by then, everyone was getting them in 30 days. But still, appeal takes longer than 30 days.

Note: if you didn't include the dates of the trip in your invitation letter (Sponsor) and statement of purpose letter (PA), that can be as silly as that: they will say "not consistent with temporary stay". It's not enough to just put the dates in the box fields in the online questionnaire for TRV application. You also have to put the dates everywhere. so to speak.

I m not saying that's what you did. Im just giving an example.

this situation did not happen to me. but when I was doing the trv, I spoke to a lawyer. and ran case scenarios with him. to be prepared for all eventualities.

I applied after receiving AOR and Eligibility letter of sponsorship approval. I included booked ticket and specific date for departure from January 15 to February 20, 2024. I went to the MP office and I will see what they gonna do.

Can you recommend an Imm Lawyer in Canada?

Please, do post on here if you don't mind to let me and others who are going through spousal TRV, to help us understand IRCC obscure functioning.

Had you mentioned you would cover travel insurance? That's the next place where my mind goes for the reason for refusal.
Also: they are processing PR applications rather quickly now. Sometimes faster than 10 months. I have reports of people being approved in 2.5 months or 7 to 8 months. Something to keep in mind vs timeline to appeal TRV decision.
Unless you are doing it for Quebec (then, I am sorry). Where it's 36 months right now.

Lawyers:
1) Steven Meurren - always super active on X and has extensive knowledge of TRV appeal process or successful TRV re-application
2) Maxime Lapointe - sued the government for unfair IRCC treatment of spousal pr applications. Dropped case when clients obtained resolution.
3) Michael Di Lullo - very knowledgeable, but sometimes a bit behind on the latest info about processing times, however on what really matters: very very top notch - And most affordable of all 3.

My wife finished biometrics and passed medical exams before applying to TRV

I'm not in Quebec.

I made an affidavit of financial statement to confirm full responsibility of all expenses including travel, accommodation, food, domestic travel and any other expenses. I also mad an explanation letter to explain ties like family and university, she is unemployed and she has some money in her account around $10000. I provided my bank accounts and statements and made it clear that I'll cover the whole trip expenses.

My friend got the PR in 4 months and I hope I'll get it early. That is why I'm hesitant to call a lawyer and make an appeal because you mentioned that it takes long time.

Do you have personal experience with these lawyers? what is their fees?

It does seem like you were unjustly denied a visa. and I spoke to a lawyer in france who deals with similar stuff for france: and she said to me: it doesn't make sense. sometimes two cases are very similar. but one gets approved, the other denied.

My educated opinion (though I am not a licensed legal expert), is to re-apply after getting notes and directly address the reason for denial as inconstant and not making sense (of course say that professionally) with your application. and explain why. Different officer. Maybe you will get approved? It will be faster than review. and much cheaper.

I am very sorry it seems you were the victim here.

As far, as appeal or judicial review: yes, it does take a long time. so if you think your process is moving smoothly: I say hang in there.

I have seen Michael on a consultancy capacity. he didn't represent our case. He charges 225$ per hour. No tax, because it's technically your spouse in Abu Dhabi he would counsel. Even if you are the one taking the meeting. As their representative. can be done on zoom.

I don't have experience with Maxime Lapointe. He charges double.
No experience with Steven. But Michael asked me who I was getting my info from as far as research, and I said: Steven. And he said he like Steven.
