What is the status of your refugee claim?

For the exemption question, we can't answer that. This is something you need to determine based on your reasons for applying for PR under H&C.
well for q8. is fair enough if you are not able to answer that got you.
but for q6. let say refugee is approved, does make any sense to claim for H&C??? come on ... or let say refugee is dismissed then just you can simply say the answer yes or no. that is it

I wouldn't say is that straight forward. We have people here apply with refused refugee claims but appeals in progress, some where appeals have also been refused, others who didn't appeal, sometimes abandoned claims. Details can matter. That's why I asked. Good luck with your application.

Received the AIP for my mother today. Cannot express in words how I am feeling. Timeline below

Submitted: 24 Aug 2023
Biometric: 07 Sep 2023
AOR: 14 Sep 2023
AIP: 02 Aug 2024

Case: Medical inadmissibility for my father. Best Interest of Child (my 2 kids). Only sibling also Canadian citizen. No one back home to take care of my day-to-day medical care. No donor arrangement in India for getting blood for regular transmission.
Complication: Father passed away 24 Sep 2023. I thought our application has become weaker since medical case is no longer applicable. Updated application using webform, submitted psychotherapists letter. We were/are going to grief counseling.

hello, any update on 2nd stage?
I used a lawyer. Good luck to everyone.

My application was based on the best interest of the child. My 5 years son is autistic, borned here...and my process took around 13 months until the AIP, so.... Normal process time for me. And my lawyer didn't mention anything about different process time for our case.
Any update on portal 1 email?

I have a question about residency requirements after submitting a Humanitarian and Compassionate (H&C) application.

I submitted my application in August 2024 and completed my biometrics in September 2024. Since then, I haven’t received any updates from IRCC. Currently, I’m on a Post-Graduation Work Permit (PGWP), which expires in March 2025.

I’m planning to apply for a visitor record to extend my stay while awaiting a decision on my H&C application. However, I understand that even if the visitor record is approved, it typically grants an extension of up to six months. This would take me to around August 2025, marking one year since my application was submitted. If my H&C application remains undecided at that point, I may have to leave Canada.

I’d like to confirm:

  1. Will leaving Canada impact my H&C application?
  2. If I am outside Canada when my application is processed and approved, will I be able to return to Canada based on the approval?

It is possible you will get a one year visitor record and not six months. The length of time and whether you are approved will be up to IRCC. It's also possible the visitor record may be refused since you have submitted an H&C application.

1) If at all possible, it is recommended that you remain in Canada, even if you fall out of status. Generally the chances of approval for an H&C application drop of you leave Canada.
2) If you end up leaving and are approved while outside of Canada, yes, you will be able to return.
