SOWP extension Issues and suggestion due to passport expiry and main applicant part time job

Hi All,

I have below queries regarding my SOPW extensions based on my wife's dependent visa.

Option 1:
Can you let me know if my SOWP is expiring on 15th April 2024 due to passport expiry date and my wife's study is going to be finished in December 2024? So, she must apply for the work permit in Jan,24. I am in India right now. So should i go to canada to apply her PWGP and my extension together?

Option 2:
Or can we apply my extension after she has applied her PGWP and her status will be on applied. Because i have seen that final 3 years work permit takes around 3-4 months and if she applies in January it will be around in may and my visa is getting expired in 15th April,2025. So can i apply my extension after i land in canada in feb end with her application status as applied ?

Option 3:
My wife student permit is till 7th Sep,2025 i got sopw till 15th April,2024 due to my passport expiry. What if i can extend it on my new passport till next sep,2024 in feb end at border,

Should I apply for my SOPW extension with my wife even if she does not have a full-time job as she is working part time in the otter co op as a cashier which is kind of Walmart style grocery store.. What if I lose my status after 15th April and i am in canada because of her part time job and extension rejection due to that, do I have to apply for the SOWP again as a fresh candidate, or can I apply for restoration of status from India?

Any help will be appreciated.

Hi,

1. how much time do you plan to be in india? If you dont plan to come to canada, you have to inform IRCC. you cant visit for application and then come back to india.

2. Best practice is to apply together. You can find it on IRCC website. If not applying together, your wife's PGWP should be APPROVED first and you also have to submit her Full time job letter, paystubs, etc.

3. If she applies for her PGWP, her study permit got canceled. You will get conditional letter for your wife to continue work. So no point in applying for your extension since you dont have your wife's supporting doc.

If your extension got rejected or you current WP expires, you will be given 90 days to apply for Restoration. But until your reapplied decision comes, you are ineligible to work. Better to atleast apply for Visitor's visa so you can have a visitor's status. If you are out of canada and your WP got rejected or expires, you will have to apply for out of canada as a fresh candidate.

better to contact a lawyer to make things clear, then regret later.

I will go back to canada and will apply for SOWP extension within Canada itself as it seems it will take more time from India due to ongoing tension. It seems that my wife will not receive her PWGP before my expiry of visa as it is taking more than a 4 months. So i will need to apply for my extension on her implied status it seems and hope for the best including her offer letter and 3 pay stubs. If you are out of Canada and your WP got rejected or expires, you will have to apply for out of Canada as a fresh candidate. (this is the reason i will apply within Canada itself.)
