Update: My dad's passed away from stage 4 colorectal cancer yesterday, leaving my mom behind. I promised him a lot and i failed to deliver. I have my two sisters and nephews here, so that helps, but the worst part about the whole situation is i cannot go to his funeral, cause that would mean my TRP gets discarded and i get an automatic deportation order. After this whole situation a stay in Canada doesnt matter to me anymore, but i cant be travelling to other places around the world with a deportation on my record. I havent worked, havent broken any further rules, the only thing i did wrong was taking 3 unauthorized breaks while on my study permit to help out my sister who was pregnant with my nephew at the time, and that was a lapse in judgement, i feel I've been punished enough. I am just tired.

Sorry for the loss of your father.

Why will you get an automatic deportation order?

Thank you so much, I really appreciate it.

I just fear that would be the case because I've heard (from reddit)that if you leave Canada voluntarily without a status, you automatically get a deportation order.

This is completely false. This does not automatically trigger a removal order.

Hi everyone My Mother was on super visa and lost status as they refused extension We applied TRP may 2023 and applied H&C with strong grounds but also refused . TRP still in process . If they approve TRP and if she goes back home and comes back as she still has supervisa for more 2 years .would she get entry without any problem ? Because she lost status but if it gets restored with TRP and she applied H&C. Will these things be a problem for her entry ?Please reply

Depends on the type of TRP she is given, the best case scenario for what you're hoping for, is if she's given a multiple entry TRP, If she isnt given a multiple entry TRP and she leaves, its more than likely she wont be able to come back(not anytime soon anyways). As for her Visa, she might have to apply again with her TRP as her status just doesnt continue on once a TRP is given, its more of a reset.

Thank you for your reply . If TRP is a reset of out of status then why she would need TRP to come back because she has valid super visa .I m not sure if this makes sense what I am saying . I am very new to this TRP thing.

No worries, unfortunately for your mom, when her status expired, her super visa did too, at this time she is undocumented. So what a TRP does is give you permission to stay in the country for an amount of time while you get a visitors/study/super visa. The applicant(your mom)will need to give a compelling reason why she cant leave Canada(death of someone, child being born or sick etc with proof.) Unfortunately she will need to keep applying and renewing her TRP with her supervisa until she leaves canada or goes for a permanent status, its just the way the immigration laws here work.

Are you sure if her status expires her super visa too as we applied TRP already before 90 days of expire .Any website link confirms this please .

With a failed H&C claim you should assume future entries into Canada may not be straigh forward and she may in fact have problems. This is due to the overstay and also the H&C application which demonstrates she has an intent to remain in Canada long term. It's also possible the super visa may have been canceled.

If she leaves Canada, suggest she remain outside of Canada for two years to re-establish ties to her home country before attempting to return.

Out of curiosity when did she apply for H&C and when was she denied? There seems to be a large volume of parents applying for H&C t because of the wait for PGP so assume IRCC may become more strict about approving these H&C applications.
