Express Entry - Job experience query

Hello All,

I am in the process of completing my express entry profile, and have a couple questions:

1. I immigrated to Canada through a intra-company transfer. I worked for the company from June 2021 to Feb 2024 in the US, and moved to Canada in Feb 2024, and continued working in the same role. (got promoted in May 2024). This is the only work experience I have. As of June 2024, I have gained 3 years of work experience. What should I enter for my work experience years question? Should I tell its 3 years of total foreign experience, or 2 years worth of foreign experience?

2. I have a bachelor's degree, and a master's degree. I have ECA only for the Master's. Should I add my bachelor's degree record in the Study & Languages section of my express entry profile?

Your employer doesn’t need an LMIA to support your job offer if:

  1. you have been working full-time for the employer on your work permit for at least 1 year (or an equal amount of part-time work)
  2. you have a valid job offer, and

Your employer doesn’t need an LMIA to support your job offer if:

  1. you have been working full-time for the employer on your work permit for at least 1 year (or an equal amount of part-time work)
  2. you have a valid job offer, and
Do you really have a valid job offer? Not any job offer is valid.

And 200 points are only for specific NOCs.

Real is not valid.

Here is a definition of a valid job offer:

Federal skilled workers and Canadian experience class
A job offer is valid if the job is

  • working for one employer
  • continuous
  • paid
  • full-time (at least 30 hours a week)
  • not seasonal
  • for at least 1 year after we issue your permanent resident visa
  • in a NOC TEER category 0, 1, 2 or 3
It also must be made :
  • by an employer with a new positive LMIA that approves the offer and names you and your position OR
  • if you’re currently working in Canada in a NOC TEER 0, 1, 2 or 3 job on a work permit that was issued based on an LMIA, and:
    • you’re working for an employer listed on your work permit
    • you’re authorized to work in Canada on the day you apply for a permanent resident visa, and when the visa is issued
    • your current employer made you an offer to give you a full-time job for at least one year if you’re accepted as a permanent resident OR
  • if you have a valid work permit for a NOC TEER 0, 1, 2 or 3 job that is exempt from needing an LMIA, and you:
    • are currently working for an employer specified on the work permit
    • have one year of full-time work experience (or an equal amount of part-time work) for that employer
    • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

And be careful with NOCs of TEER 0, it's not all that are called managers, it's a high level position with a specific level of responsibility, duties and salary.

No.

Employer needs to obtain an approved LMIA if you are on an open work permit. You can only claim the job offer points under the above rule if you are on an LMIA exempt closed work permit with the employer named on the work permit.

Having a managerial job is also not sufficient to claim the 200 points. It has to be a very senior managerial job like CEO or CFO of the company.

If you hold an open work permit then job offer points are zero without an approved LMIA.

This doesn't look like a tier 0 occupation so 50 point with an approved LMIA from your employer.
