Job Offer........
Pre-Assessed..
I'm done with my almost 2 months of Job ads through the following websites: Job Bank website, Indigenous Job Portal, Kijiji Website, and Canadian Nanny
I did advertise for an $18/hour and NO PR and Cad Citizens applied. Can I apply for a LMIA but what will I follow as a salary per hour? Can I offer below the $18 compared to the per hour I advertised? How much is the lowest I can offer for a TFW? Can I offer $15.50 or the $16.55 per hour for a 40 hours week in Toronto?
How much would the Monthly? Yearly?
Is the computation correct:
Yearly Gross Salary - $33,100
Monthly Gross Salary $2,758.34
Hourly Salary - $16.55

Monthly Gross Salary $2,758.34
Monthly net amount $2,281.54
Monthly Deductions: $476.80

Employee Tax Deductions $285.07
CPP Employee Deductions $146.77
EI Employee Deductions $44.96

EMPLOYER TO REMIT TO Payroll Tax - $686.51
Tax $285.07
CPP Employee/Employer $$293.54
EI Employee/Employer $107.90

Does this mean that the total that will come from my pocket monthly: Monthly Net Salary of $2,281.54 + Remit to CRA $686.51 = $2,968.05? THANK YOU

And also can the prospective employee apply inside Canada for a Work Permit? She has a 10-year Temporary Visitors Visa issued in Manila Phils. Or she needs to apply in Manila once I received a Positive LMIA? Thank you for your insights.

You can only apply for a LMIA if you are in Quebec. If not, employee must apply through HCCP program with IELTS and ECA and job offer. This program opens and closes on January 1 so she needs all her documentation ready for that day. Processing is a few years. The salary must be the median wage for Toronto Which i think is $17.50.

Oh so no need for me to apply for LMIA? A Job Offer Letter is enough? She has IELTS already and WES ECA. So does that mean she will wait the Jan 1, 2024 opens? I thought she can come here and apply here for a WP. Thank you.

IRCC doesn’t allow for LMIA for caregivers unless you live in Quebec. The rule changed several years ago (link) so your employee applies directly through the HCCP program for PR, and will get a work permit through the program to gain experience. She needs to be eligible and ready to apply on Jan. 1. It will close on that day because it is based on quotas and is very popular. From then it may take up to 3 years to get her work permit.

Look at the median salary and make sure you meet that.

It says on the IRCC website that if you are a visitor in Canada, you are not eligible to apply for an LMIA-based worker permit for NOC 44100 nor NOC 44101. They have also put through a prohibition of the issuing of such visas at the border for people coming in.

Do you mean the caregiver must live in Quebec or the employee must live in Quebec?
How long do you have to live in Quebec?
I'm asking because I have an approved LMIA under LOC 44100 and upon applying for work permit I discovered there is a refusal to process LMIA for visitors in Canada.

Employer lives in Quebec. Is employer in Quebec? To be eligible

You can apply for a work permit for a job as a home child care provider or home support worker through the TFWP if 1 of these applies to you:

  1. You’re currently outside Canada and you’ll be working in Quebec.
  2. You’re currently in Canadaand 1 of these applies to you:

You quote a lot about processing being a few years.. do you know this will be true for new PR on arrival? They say they wish to process in 6 month but you say with such authority is a few years...

You can check processing times on the IRCC site. When did you apply? Are you in Canada and working? Where does it say 6 months? You will see people on this forum waiting since 2021. But seems you have IEC which is not relevant to situations applying outland through HCCP.

Step 1: Work permit and first permanent residence review

36 months
