PGWP Extension Refusal. Just got my CIC draw ( with ONIP APPROVAL ), Can I apply for BOWP?

Hello everyone,

I would be really appreciate if someone can answer me.

my PGWP expired on March 19 and I did apply for the extension while I was waiting for my ONIP certificate, I was also working under implied status
My ONIP certificate has been approved like a month ago, and my CIC application has been drew recently with the score of 965 and I'm about to submit the application as I'm writing this thread.

I just got the refusal on my PGWP yesterday after 4 months and wondering if I can apply for the BOWP and start working? or any suggestion what I should do? Im still legal to stay without working under visitor record!

No, unfortunately you can only apply for BOWP if you have submitted your PR Application and received AOR. See: https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/extend-permit/bridging-open-work-permit.html

You should restore your status first, as soon as possible. See https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/permit/temporary/restore.html

To qualify for BOWP would also have to still have a valid WP. Agree apply for restoration but that only gets you visitor status not a WP.

Hmm I don't know if you have to have a valid work permit but I could be interpreting it wrong. The IRCC BOWP Page mentions either of three:

• have a valid work permit
• have an expired work permit but maintained your status as a worker
• be eligible to restore your status and get a work permit

Were you eligible to ask for the extension or as some do, request and extension knowing it’ll be refused, so that they can continue working ?

Depends when your work visa expired. If more than 90 days ago then you cannot restore your status to visitor and apply for BOWP.

Just want to clear things. I never went out of status. Before my work permit expires, I change it to visitor records and stopped working. Once I got an ITA, I will apply for PR then apply for BOWP using AOR. This works fine right?

As for someone that went out of status, they should restore their status to visitor within 90 days of being out of status. Is this right? Thank you.

Ok. So if you get ITA, applied and have AOR within 90 days of work permit expiry then you can restore status to worker and apply for BOWP. Don’t know if you can work until BOWP is approved.
