SOWP Refused - Outland Applicant + Timeline

My spouse's open work permit application was refused due to the following reasons, which mostly seem counterintuitive as the whole point of an outland SOWP is to reunite with my spouse, so of course their family tie would be stronger in Canada.

  • I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 200(1)(b) of the IRPR (https://laws.justice.gc.ca/eng/regulations/SOR-2002-227/section-200.html). I am refusing your application because you have not established that you will leave Canada, based on the following factors:
  • The compensation (monetary or other) indicated in your job offer and your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable).
  • You have significant family ties in Canada.
  • You do not have significant family ties outside Canada.
  • The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.

Any thoughts on what our next steps could be? Would appreciate any comments from folks in a similar situation.

It's not that straightforward as it seems Work permit is temporary anyway, so yep, they need proof and guarantees of the return.

And looking at the list, you definitely need to rework your application. There are many more issues than just ties.

What is your status and when does it expire? How much liquid savings did you show and are you employed? Did you apply right after marriage and if so did you have an extensive in person dating history? How much time have you spent in person after marriage? Is this your second spousal sponsorship?

Have you submitted a spousal/family class sponsorship application for this spouse? Is your spouse in Canada now?
Are you in Canada?

If you are trying to submit and OWP for your spouse during the sponsorship application, your spouse needs to be in Canada and your sponsorship application needs to have received the AOR email.

Post in the family class sponsorship section if that's the OWP you are referring to. Otherwise, please explain what you are trying to do.

If not, are you not a PR/citizen any more? SOWP is for foreign workers and students to apply outside for their spouse to come and work in Canada during their temporary stay.

Could you elaborate on this? What do you mean by "you need to rework your application"? What do you think I can add as proof that the applicant will return to their home country?
