Super Visa Rejected. What to do?

Hi,

I just recieved notice that the supervisa application for my mother was rejected on the following grounds :

The purpose of your visit to Canada is not consistent with a temporary stay given the
details you have provided in your application.

What do I do now? What are my options? I really want her here in Canada with me.

Order GCMS notes. What did she show that she would return?
Thanks will do.

She mentioned her duration of stay to be slightly more than 1 year.

But we didn't really provide anything specific to prove that she'll return. However, this had worked for us in past applications of tourist visa and a current super visa (which is expiring because her passport was expiring in a few months)

She doesn't have any property in her name. What are some things that we can show as proof that she'll return?

Just a couple of more questions -
1. She only has Pension. Will this alone suffice?

2. Also, do we need to prepare a fresh application or is there a way to provide clarifying information in the same application?

3. If a new application is needed, can she apply right away? Or should she wait for a bit before that? And is there a limit to how many times she can apply?

3. Yes, if she can address reasons for refusal. She can apply as many times but if refused over and over then IRCC will think she is desperate to come to Canada.

One Final question - She had mentioned the reason for coming to Canada as - Visiting me (her son) and providing a family kind of environment for her grandson (who is 7 years old) in his formative years. ( I am paraphrasing)

Is this a good enough reason for a Super Visa?

I mean - My son had grown up always having his grandparents around in the home country. Even after moving to Canada, he's had them around (on Tourist visa/super visa) . So, the intention of my mom was to preserve this familiar family setup by being here for 1 more year while my son is still young. (my dad already has a valid super visa)

Order GCMS notes as I wonder if your wording was enough for IRCC to think that she is caring/looking after your son.

@Naturgrl - Got the GCMS notes. Couldn't find anything new that wasn't already mentioned in the refusal letter. It only had logs of the standard refusal letter text being added to the file. No additional notes left by the visa officer.

Do you reckon submitting a new application with Pension information should cut it this time? Or are there any other things that I can supplement the new application with to make a stronger case?

Also , should I make adjustments to the duration of stay and reduce it to 8-9 months instead of a full year?

Really afraid of getting rejected again :(

How long has she spent in Canada? You mention having grandparents always around. Have they been visiting Canada this whole time?

Cannot thank you enough for your prompt response @canuck78 .

My mother has visited Canada twice since 2020.

Visit 1 : Feb 2020 to Oct 2021 ( She had originally come for 3 months on a Tourist Visa but couldn't travel back because of COVID . We got her visa extended successfully a couple of times )

Visit 2 : March 2022 to Feb 2024 ( This was on a Super Visa. Since her passport was expiring in Aug 2024, she returned to her home country to get the passport renewed and apply for a fresh Super Visa . That application is the one that got rejected )


This was the Reason for Visit cited in the rejected application:
I wish to visit my son and his family ,offering support for my 7 year old grandson in his formative years and fostering familial bonds. My son is a Canadian Citizen ,his wife and my grandson are Permanent Residents. As things stand now, I wish to render my support beginning June 2024 and continue to be with my family until the end of the school year in 2025. I graciously seek an opportunity to contribute to the well-being and development of my loved ones.

Also, she added some more clarifying details about ties to home country in a letter of explanation (which I now realize was quite flimsy) :
I wish to assure you that I have every intention of returning to my home country after the trip ends. My husband and I have entered Canada on multiple occasions and have traveled back at feasible times. My husband owns a house in our home country that we live in. It's upkeep is our joint responsibility.

I had mentioned something on similar lines in my invite letter as well :
My Mother is applying for a Super Visa so that she may visit me for an extended period from June 01 2024 to August 15 2025 to provide assistance to my 7-year-old son during his crucial developmental phase and strengthening family ties.
Her presence during the school year will allow her to contribute to the welfare and growth of my son while also allowing my wife and myself to carry out our professional duties a little easily.
My mother will stay with me and, while she can take care of herself financially, I will provide for all her needs and necessities for this trip.


On this note - majority of the funds that she showed in her account were actually in the form of fixed deposits (kinda like GICs in Canada). Would that be a cause for concern? I presume that it's really my income and finances that matter in the application and not hers.

We now have documentation about my mother's pension and a certificate from the bank mentioning that she needs to physically be present in the country to get it.

Would really appreciate your guidance on strengthening her fresh application

Your letters certainly did not help. You have both essentially declared that you want your mother to spend a large portion of her time in Canada like she has already been doing. Also caring for your son which could be considered illegal work. She should also be able to show some liquid funds although that may not be a huge issue. Would wait for GCMS notes before reapplying to know exactly what you need to address.
