I'd like to apply for a work permit through flag poling. I hold a Canada Visit Visa and traveled to Canada in January 2024. I also have a visa to the United States. I am currently in Dubai, and I received LMIA on May 20, 2024, with my name on it. I learned that when the LMIA is granted and they put my name on it, I must be in Canada. However, I was in Dubai when they put my name on LMIA. If the immigration officer at the airport learns that I am entering Canada on a visit and subsequently go to the border to do flag poling, he will prohibit my entry.

My question is since I have a US visit visa, may I come through the US land border and flagpole at the Canadian border, rather than flying in Canada and then going to the US border and then returning with a yellow slip when the US border deny my entry since I want to do flagpole? I am an Indian National.

So, whether I enter by air or land, will a CBSA officer know I'm coming for the flagpole? Does it indicate that I received LMIA on their system? The last time I arrived at Pearson Airport, I didn't meet a CBSA official; instead, I completed KIOSK paperwork and went to get my luggage.

The following foreign nationals are permitted to Flagpole:

  1. Residents of visa-exempt countries with an LMIA-exempt job.
  2. Residents of visa-exempt countries in possession of a positive LMIA.
  3. Residents of the U.S., St. Pierre & Miquelon and Greenland.
  4. Residents of visa-required countries already in possession of a study or work permit (flagpoling for the purposes of renewal).

You are a resident of a visa-required country, so you can only Flagpole if you already have a work permit ( for reasons of renewal ).
