I pleaded guilty to DUI charge in 2018 and now i am looking for options that can help me overcome admissibility issue.
It is the only offense in the last 6 years i have been in Canada, I have a daughter who is Canadian citizen and a boy in grade 4. I was being exploited by my employer so had to quit the job, I have told immigration about everything but due to DUI they refused me the open work permit for vulnerable people. Now CBSA has taken my passport and issued me deportation order. I have applied for PRRA and wait on it. I was sent a confirmation letter this week that my PR has been approved and a day later i was told that it was issued in error. I have applied for TRP but have not received confirmation from Edmonton. I have applied for PRRA work permit as well and waiting on it. I am also trying to see if i can get the guilty verdict vacated. I am also working on sending an application for clemency. I have applied for pardon for dui which is due in about 2 years. My question is, is there something else that I can do to o overcome admissibility issue. Thank you

The only think I can add is to make sure you are working with a very good immigration lawyer for the PRRA & TRP - and with a criminal lawyer for anything related to the pardon. The PR application approval was definitely issued in error. The fact they have withdrawn this makes sense unfortunately. Good luck.

I am PR and I got charged with DUI. I was chilling in my car, not driving. My criminal lawyer got me a plea deal of 1 year driving prohibition and $1000 fine for first time offence. It is still going to be a criminal record.

Should I accept the plea deal?

Will I get deported?

do not accept the deal. fight with a good dui lawyer as it may cause trouble on your PR.

If chilling then why DUI? It literally means Driving under influence. Why plea then?

If you are convicted of DUI you will be inadmissible to Canada.

Although you were `chilling in your car'...were the keys in the ignition? I ask because I knew someone who was also chilling in their car but their keys were NOT in the ignition. It made a big difference in their case.

Actually, it's still violation if the person stays in the driver's seat (and specially with key in ignition or in pocket for keyless start car). People should sit in the other seats if they drink too much and want to rest in their car.
Wow, I just learnt something new today. Thanks for the info I didn't knew it, my perception was that if the engine is not running its all good.

It is in fact if you are in the car and in possession of the keys, it's a DUI. Had a friend sleep off a long night and convicted of DUI sleeping in the back seat simply because he had the keys in the car with him.
