I am sponsoring my spouse for open spouse work permit. But he was refused visit visa to UK in 2017.

I am currently holding valid work permit in Canada and I would like to sponsor my spouse and 2 children to join me in Canada. My spouse applying for open spouse work permit, have mentioned his prior visit visa refusal to UK in 2017. His travel history includes - Work in Singapore on S-Pass in 2013; 2 to 3 times to Singapore on Visit visa in 2015, 2019. I am concerned if his work permit application will be approved or not. Does the UK refusal have any impact on his application decision?

UK refusal shouldn’t have an impact as long as declared. What type of WP do you have, how long is it and what is your NOC? The amount of savings you have will be a factor for approval. Assume you have been married for many years and you are both biological parents to the children you want to bring to Canada. Length of relationship with your partner and time spent in person can also influence the ability to get an SOWP.. Had you been living together as a family before you moved to Canada? How long have you been living separately?

I am still in India and will be travelling to Canada in first week of April, 2024. I got my WP approved in Jan 2024 which is valid employer-specific pre-approval for a work permit in a high-skilled TEER 1 occupation, NOC 21222 , W-1 category valid till 02-05-2025 and earnings proof with funds of $97,000 from my current job.

We have been married for 8 years and biological parents for 2 kids ages 7 yrs and 3.5 yrs old. We do have marriage certificates and children birth certificates and Insurances with nominees as one another. Currently we are living as family in same house along with our in-laws. We do have proofs of our marriage like photos and certificate.

A visa refusal is not a problem.
The problem would be if he was deported or overstayed beyond visa period.
