Permanent Resident parents but child is not

Hello,

My wife and I are both PR holders but my son was born in Riyadh, Saudi Arabia where we currently live. Since we were outside Canada, we were not able to start the sponsorship application for my son from Riyadh but instead needed to be in Canada physically.

We are planning to move to Canada in the next two months permanently, and we had applied for my son under temporary visitor visa. Unfortunately, the visa got refused stating that the officer was not convinced my son will leave after his period of stay. However, I had given all documentations related to return tickets within the 6-months period and explained how we will apply for sponsorship for him once in Canada and if it does not happen within the 6-month period, he will duly leave as per arrangement.

I am unsure what to do now as I cannot leave my son behind. He is just one year old. Has anybody faced a similar situation? Should I apply for a temporary visit visa again? Any help would be appreciated here please.

You can try and apply for a TRP. If refused, the only was is if one of you comes to Canada and starts sponsorship process. Do you meet RO to sponsor him? This is a common question on this forum.

Thank you for the response. May I get more understanding on what RO means? I have looked at the website and seems I should meet the requirements to sponsor my son but only after I am there physically in Canada.

Thank you for clarifying. My PR card expires in Jan 2028. I have not yet lived in Canada but went once to complete my landing and get necessary documents.

Ok. So you meet RO. Apply for TRP but one of you should be planning to move and settle in Canada so you can sponsor your child if TRP is also refused. This is an issue for many people and not uncommon that TRV and TRP are refused. IRCC knows that child is not coming to visit but apply for PR and stay.

Additionally, can you help me understand the below scenario as well? Or if I need to write in a separate forum, I am open to it also:

I am scheduled to arrive in Canada (tentatively April 2024). My initial landing date was 10Aug22, so landing in April '24 puts me in the right position to apply for citizenship after completing 3 years of stay. I am aware that if I spend two years in Canada (i.e. arrive in 2025), I will be eligible for a renewal of PR. In this PR renewal situation, can you let me know if I will need to spend another additional 3 years to get my citizenship, i.e. spend 2 years for renewal of PR (2025-27) and 3 more years (2028-30) totaling 5 for citizenship? Or, will I be eligible to apply for citizenship one year after PR renewal, i.e. spend 2 years for renewal of PR (2025-27) and 1 more (2027-28) year totaling 3 years for citizenship?

PR renewal and citizenship are two different things. Some people are PRs and just renew but never eligible for citizenship. For citizenship, you will need to live in Canada for at least 3 out of the last 5 years (1,095 days)

Got it. But does the three years count for separate PR tenor? For example, I stay two years and renew my PR and then after one year of this renewal, I can apply for citizenship? Or do I need to spend three years within a specific 5-year PR validity period?

You need to live in Canada at 3 of the last 5 years for citizenship. Many people never get citizenship but maintain PR status as they live in Canada, and leave for a year or two, and then return.

There is also the possibility that chances of approval are higher (possibly much higher) if one of the parents returns to Canada, submits the PR application for the child and the TRP app at the same time (or just after). Unfortunately can't say that this is a guaranteed thing, but may be worth accelerating return of one parent. (Since presumably the other parent wouldn't be able to come if TRP refused anyway)

When did you land as a PR and when was your child born? Hopefully you child was born after you and your spouse had already landed as PRs.

When I applied for TRV for my daughter, I advised them my daughter will stay with us permanently in Canada and we will apply for her PR right away. We also said no one can look after my daughter if she doesn’t come back to Canada with us and she got approved for 5 year multiple entry visa.

Guys I need your advise, I am PR holders my wife's Outland sponsorship in progress(It's been 5 months already). Her TRV is approved, she's 4 months pregnant now . Planning to bring her to canada apply for work permit once landed in Canada and using an offer letter get her OHIP and deliver the baby in Canada. My wife want to stay in India and deliver the baby. If baby is delivered in India. I have to go through baby's PR process which is taking 10-11 months of processing time on IRCC portal. Please advise, Which option is best delivery in India or Canada?
