I just applied for BOWP 4 days before my WP Expires, what happen to my STATUS if I'm not getting an electronic response before my WP expiration date?

Hello,
I have some doubts about the application of my BOWP, I just applied having only 4 buffer days before my WP expires, the reason I did this it was because a couple of weeks ago I received my credentials for PR Portal so I uploaded my PR Photo and I was just waiting for my ECOPR, however IRCC asked for additional documents (KIT Application Forms) for my dependents since my marital status change after I applied and received my AOR for the PR.

So my questions are:

  • What would be my status if I am not getting a response before my WP expires 2024-09-02? (knowing in advance I am just providing additional info and then I will wait for the ECOPR).
  • How I can proof to my current employer that I have "maintain" or "implied" status to keep working if I do not have any evidence or confirmation about the acceptance of my BOWP before my WP expires, 2024-02-09?
  • What if I am laid off even I am not having yet my BOWP confirmation, either confirmation, electronically or physically.

I am hoping I would be getting my ECOPR much sooner than the BOWP so I have no to worry about my last question.

This is precisely the reason why one should not submit an application days before the expiry. The process may be bogged down and you end up loosing status. In your case, you MUST STOP WORKING at the expiry date if you have not received the implied status letter. You are technically out of status at that point pending the extension letter or receiving COPR.

The only thing why I did not apply much before it was because I was waiting for my ecopr during 2 months and when it seemed to arrive, IRCC asked me for additional forms (family dependents) so they had 4 more months before they came back to ask for such forms but they never did it until one week ago , therefore I applied for the BOWP.

Fortunately, I got it one day after I submitted the BOWP application, so now it is only a matter of time to wait for the ecopr once I submit the family forms which would be happening this week.

If I told you my whole odyssey with IRCC…

I got refused my PR Application on last July, since my work permit did not show my LMIA Except number nor my employer name so the 50 points I claimed for the CRS score, they said I did not have such 50 points since they did not find evidence of it.

So I found out that my current WP was wrong and was given to me with such lack of information by the border agents the first time I arrived to Canada.

My story started to looks better after I sent 3 letters explaining and begging them to review thoroughly the information and evidence I was sending to them, so after 3 attempts they finally helped me out to Re-Open my PR Application, they never apologized and never acknowledged that they had a 2 mistakes:

The first one, when they gave me my WP, mistaken.

The second one, when they never reviewed my previous 2 letters I sent after my refusal.

So at the end of they day, they are the ones delaying and affecting people, so they should pay the fees for the BOWP, at least

One would think that would be grounds for a refund but it is not. Happy to hear you got the letter, hope they done ask you for more info after the next month or so.

Read this . It has all answers to your questions. Applying WP extension before few days of expiration date is not a crime . You are still on maintained or implied status if you submitted work permit extension even one day before. Maintained status is called legal status.

You are covered under implied status and you can continue to work while they send you the work permission letter. Your only problem could be with the employer. Some employers want you to have the letter in had. Employers who are more experienced in the immigration process understands that the letter may come at a letter date. Others would ask you to stop when the permit expires and wait for the permission letter.

My spouse applied for BOWP as the main applicant after we got AOR, and I am the family member in this application. My spouse can still work on maintained status since he had a valid work permit when submitted bowp, but i was on visitor record since my work permit expired before we got AOR.
My question is, can i also still work before i get the actual work permit on hand? Like i only have the submission confirmation letter!

No you can’t work until you receive your actual work permit. You currently hold visitor status.
