Hi, I have a relative that is visiting canada, at this moment. She is my sister-in-law. She is staying with my wife and me for a couple of months. She is from venezuela, and we are citizen, we meet all the requirements. This process came while she was here already, and the instructions says that she should be in venezuela before submitting the applications. however, she still wants to apply. Do you think IRCC can consider her process? Can you please give me some opinion about it?. I am thinking of submitting an explanation letter.

Yep, makes sense. You're caught in the middle.

The IRCC requirements are crystal clear. There's no question your sister-in-law doesn't qualify if she applies while in Canada. If your wife and sister-in-law want to ignore the requirements, that's ultimately their call. IRCC does not give flexibility on requirements so a letter won't fix the situation (and I'm not even sure what you would say in that letter).

There are only 15,000 spots available in tis program and they will go quickly. Your sister-in-law can chose to apply without meeting the requirements. As you know, it takes a while for IRCC to process applications. By the time her application is refused, the 15,000 spots will be gone and she will have lost her opportunity to get PR easily through this pathway. I don't understand the logic of squandering this amazing (possibly once-in-a-lifetime) opportunity by applying when you clearly don't meet the requirements. If this was me, I would be rushing to get my application together asap and would be on the first flight home so that I can submit the application from there to make sure I fully meet all of the requirements. But ultimately your sister-in-law's call.

I can not send her back right now. She just got here, and I brought her to help us with our toddler. It is very sad, that process was just released after a week she just got here. She does not quality for express entry at all, and for this process we could help her easily. Things happen for a reason. The thing is that they see me as the villain, but the requirement is very clear.

One more question, The application says that she needs to submjt in any of those countries. So what about if we complete the application, eend her to mexico for one day, submit it with the updated application, saying that she applied from there with her updated travel stamps as well, and then come to canada immediately after submission and wait here. The application does not say anything about waiting in any of those countries, only submission. She has visitor visa with multiple entries, her visa will not get cancelled just because she applied for this, she would be in implied status right?. What do you think?

I can't comment 100% on whether the one-day trip to Mexico would work for submitting the application. I guess you can try. The instructions seem to say that you just need to be physically in one of those countries.

Keep in mind that if she leaves Canada, she will be assessed as a new visitor when she re-enters. If I'm CBSA, a one day trip to Mexico and then an immediate return to Canada is going to look very very unusual and it's possible this could create questions or issues on re-entry. So there is that to keep in mind. She is also working illegally (per CBSA and IRCC rules) by taking care of your toddler. So she needs to be super careful what she says at the border to CBSA.

I get that she just arrived. However I would personally still have a long-term view of this situation and prioritize the PR application. But I'm obviously not in your shoes. Good luck regardless what you decide to do.

The one thing I'll add... The more I think about it, the more the one (or two) day trip to Mexico feels super risky if her priority is to be able to re-enter Canada without issues. Anyway, hard to say what to do. And as you said, ultimately not up to you.

Do you mean having your BIL apply for a TRV and also the special pathway in parallel as the primary applicant? There is nothing wrong with doing that.

I assume this is your wife's brother and not your SIL's husband.

Or maybe you mean something else?
