Out of status-passport expiring

Hi,
I am an Indian citizen. My passport is expiring next month. I cannot apply for passport in canada without having a valid status (I am out of status) I am most probably applying under family sponsorship in 3-4 months. What can I possibly do? Because one of the requirement for sponsorship is passport. Will the officer accept the sponsorship file without a valid passport? And May be I can apply for a passport once I get my AOR? Is that even a thing? I am so worried because of the passport expiration.

I can't answer your first question.

For your second question, AOR doesn't give you status in Canada so I don't think that would allow you to apply for a passport. You can only get your status back once you have AIP and have gotten an open work permit. However you need a valid passport to apply for the OWP. So it feels like a bit of a catch-22 to me.

Your only real option is to return to India before your passport expires and apply for a new one. how long have you been in Canada and what status did you have before it expired?

I have been in Canada since 2015, came on study visa and my pgwp was rejected in 2019 and I am out of status since then and my passport is expiring next month

You should expect your application will be reviewed much more closely given the long overstay. Make sure your application is very strong.

yes. i wanted to understand if they would even accept my sponsorship application considering my passport is expiring next month. I am trying to also see if I can renew my passport without status in Canada but it seems impossible. I don’t know what to do

The only way to get a valid passport is to return to India. If you are trying to get sponsored you should stop working illegally if you are working without status. You will not be able to re ew your passport without status. You must have status to renew so that people can’t remain in Canada without status for long periods of time and have a valid passport.

The issue is that the OP's country requires proof of valid status in Canada to renew the passport from within Canada. This is true regardless of whether the OP renews now or after the passport has expired.

I meant apply for the spousal sponsorship - while a valid passport is required to apply, it is not required to complete the virtual landing procedure (if I'm not mistaken).

Although caveat that this is not without risks, e.g. if the application was done as inland, it would be deemed abandoned if the OP had to leave the coutnry during the process. Given being out of status, would therefore apply outland-within-Canada (could complete process in home country).

Of course, if OP cannot apply before passport expires (eg not actually married or common law yet), then this is moot.

The passport should be valid during processing. It would likely be expired before AOR. If they waited to find out then they would also be stuck until they arrange emergency travel documents which could take a while. If this family is trying to regularize their status they should stop doing anything illegal for example working without status.

Reasonable point.

To clarify (since I don't think this is fully clear): @canuck78's point on this (I think) is that if there are any mistakes or omissions that lead to it being 'returned' as incomplete, then OP would have to apply anew, and by that time, the passport (as indicated) would likely have expired, and so probably could not reapply. It is only at the point that AOR is received that the applicant and sponsor can be sure that it has been 'accepted' as complete.

We should note also - while it seems that this would be entirely in control of applicant (i.e. don't make mistakes when applying!), we've also had occasional (albeit infrequent) cases of applications being returned with seemingly no errors. There's no recourse in such a case except to reapply.
