Hello All,
I have the following 2 questions -

  1. My current work visa expires in January 2024. My employer has filed Work permit extension in July 2023. I am planning to fly to India next month, September 2023 for about 3 weeks. I believe I can re-enter Canada without any issues with some 3+ months validity still left on current visa. Please advise if my understanding is correct.
  2. With current visa extension processing taking well over 140 days, I do not expect a decision on my application until late November 2023. The processes after a decision is received also take some time (eg. sending passport for visa stamping etc.). I am hopeful for an approval. However, in case there is early decision while I am in India (approval/rejection), will it be a problem at the port of entry to re-enter on current work permit that is valid until Jan'24? Please advise.

The law firm that has filed my application has stated that the Maintained status kicks in from the day my current work permit expires in Jan'24 till the time a Decision is received. However I thought I should still check with folks here. Appreciate your help.

Regards,

Do you have a TRV?

Hi,
Yes, I have Work Visa sticker on my passport showing multiple entries allowed and expiration date in Jan'24. I was also given a Work Permit document when I entered Canada for the first time about 20 months ago.
I mean a TRV? This is a visitor visa that allows you to re-enter Canada. A work visa lets you work in Canada but doesn’t let you enter. When you say multi-entry, do you mean a TRV/visitor visa?

I don't have a Visitor visa. I came to Canada on a Closed Work Permit 20 months ago. I am currently living here. Have traveled to India last December for vacation and there was no problem in re-entering Canada as my work permit is valid until Jan'24.

I plan to visit India again early Sep'23 and re-enter Canada by end of Sep'23. I feel I won't have any issues because current visa is valid until Jan'24. The reason I got a doubt in my mind is because of my Work Permit extension application that was filed in July 23 and will probably take 4-5 months to get a decision. Hence asking the 2 questions in the original thread.

But to enter Canada you needed a TRV. A work permit doesn’t allow entry. So I believe you have a multi entry TRV valid until Jan 24.

Well, I can confirm that I do not have a Visitor Visa or any document that has TRV or Visitor word in it. All I have is 2 documents --
1) A sticker on my passport showing W-1 Category worker, multiple entry
2) Work Permit document that was handed over to me at port of entry when I first landed in Canada.

With these 2 documents, I traveled outside Canada last December and re-entered without any problem. Now also I want to travel outside Canada and re-enter after staying out of Canada for 3 weeks. I feel I won't face any issues because current work permit is valid until Jan'24. However just asking the question because my Work Permit extension is going on.

By TRV, he/she means the sticker on your passport.

I have a similar query. My open work permit and TRV are valid till 20-Jan-2024. I have already filed for an work permit extension in October 2023. I need to travel to India for a week between 01-Jan and 10-Jan. So am planning to travel outside Canada and return to Canada before my current work permit or TRV expires.

My question is when I re-enter Canada, will I be able to enter based on my current non-expired work permit & TRV and continue to be on "Implied Status" or will I be considered as entering under "Implied Status" thereby relinquishing my implied work permit status till the time I get the decision on my extension application?

If work permit is valid then enter as worker.
