I applied for extension for both my husband my 3 year old and myself our extensions were approved but my daughter extension of visitors visa was refused. Initially when we came to Canada I never had to apply for her, but I assumed she would need an extension because we were applying for an extension also. We left because of personal reasons and would be traveling back to Canada next month what should we do about our 3 year old?

So is your child in Canada? Did you apply for TRV or extension as you talk about extension. If not in Canada, an extension is not what your child needs to re-enter. Child needs TRV. An extension is only if in Canada and to remain in Canada.

Each of you needs to be holding a valid TRV to re-enter Canada. A TRV extension does not allow you to re-enter Canada.

Yes, we all were in Canada before we left I applied for the extension before we left. Initially she never needed anything and her American passport was never stamped or anything but I assumed she would need something this time and applied for her the same time I applied for my husband my myself. So can we all just travel to Canada without me having to put in for the TRV or do I have to obtain that prior to travel?

If she is US citizen, she enters on her passport. If you and your husband need TRVs, then apply for them An extension is no longer valid if you leave Canada.

I’m an international student, we got our approvals for my extended study permit and his extended open work permit. So no need to reapply for my daughter after her refusal she can just go along with us when we return next month?

But do you have TRVs. Extended study and work permits are not TRVs unless you are US citizen or from ETA country. An extension doesn’t let you enter Canada.

If your daughter is traveling on a US passport, she doesn't need anything else. Depending on what passport you and your spouse are traveling on, you may need valid TRVs. The extensions do not allow you to re-enter Canada.

Do you think it will be an issue with her refusal when we re-enter?
Entry is never guaranteed. If she had been in Canada for over 6 months and didn’t extend her stay then it is possible. How old is she?

She is 3 yes we have been in Canada for a year, but initially when we came they never stamped her American passport or anything so I assumed her time correlated with ours.

If it wasn’t stamped then she could stay in Canada for 6 months, and then would have had to extend her stay. Her time has no correlation to yours. So she was in Canada without status for more than 6 months? Again, there may be no issue when she re-enters. You will not know until she enters.

We initially entered last year July 26 so 6 months from that date would’ve been January 26th her dad and I applied for extensions in May 2023 and we thought that we were suppose to apply for an extension for her the same time and we did that and she was refused. Thanks so much, I guess we will see when she re-enters.

If going to start school then apply for a study permit for her.
