Need your help: Spousal Sponsorship

Hello everyone, my wife and I just got married in outside Canada, and I am Canada PR. We want to apply for spousal sponsorship. My wife has previously applied for a Canadian student visa and was rejected, so she may have problems applying for a Canadian tourist visa.

I want her to come to Canada with a tourist visa first, and then we apply for inland spousal sponsorship. I think we can apply for a US visa first (I used to study in the US, so we should be able to apply for a US tourist visa together), so that the chances of her applying for a Canadian tourist visa will be higher? Is such a plan feasible? Will she encounter any problems in applying for a Canadian tourist visa now? What's the best way for us (we don't want to be separated if possible)?

She can try for a US visa but doesn’t guarantee Canadian TRV. It will take some time to process and get responses for both visas. Interviews for US visas are long. If her Canadian TRV is refused, then you must return to Canada and apply. Are you planning on travelling to the US first (if visa approved) to show that she has immigration history and abides by immigration laws? That is what she would need to do. IRCC knows that she is married to a PR and will not just be visiting, and knows what you are trying to do. Having a US visa may not change anything. She needs to show ties to home country, funds, travel history etc. to be approved for Canadian TRV. In the meantime, make sure you maintain RO and are not outside Canada too long to lose RO.

Check what the wait times are for interviews for US visas in your home country. In many places they are well over a year right now. So from this perspective applying for a US visa may or may not make sense. Having the US visa approved does not guaranteed a TRV application will be approved. Assuming the US visa is approved, she would want to travel to the US for a visit and then return to her home country before applying for the Canadian TRV (in order to try to strengthen the TRV application).

She can certainly try applying for a TRV now. She will need to declare the study visa refusal and will also have to indicate that she is married to you now. Both of these factors will weaken the application. She would need to try to strengthen her application with ties to her home country such as proof of employment, property ownership and assests.

As I'm sure you're aware, you must be living in Canada in order to sponsor her for PR. It may or may not be possible for her to come with you. It's possible you may have to move to Canada first to sponsor her and then have her join you later once PR is approved (or you can try applying for a TRV under the new policy once you have AOR).
